AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY
OF APACHE JUNCTION,ARIZONA,AMENDING THE APACHE JUNCTION,
ARIZONA,ZONING ORDINANCE,BY AMENDING THE ZONING DISTRICT
MAP,CITY OF APACHE JUNCTION,ARIZONA,CHANGING THE ZONING
DISTRICT CLASSIFICATION IN REZONING CASE P7-11-05,A REQUEST
BY KEVIN RUBINSTEIN,ON BEHALF OF ROGER RILEY,FROM CB -1
("LOCAL BUSINESS ZONE")TO CR-3/PD ("SINGLE FAMILY RESIDENCE
ZONE,7,000 SQUARE FOOT LOTS BY PLANNED DEVELOPMENT");
REPEALING ANY CONFLICTING PROVISIONS;AND PROVIDING FOR
SEVERABILITY.
WHEREAS,on June 28,2005,the Apache Junction Planning and
Zoning Commission voted unanimously 6 to 0 to recommend approval of
rezoning request PZ-11-05;and
WHEREAS,the proposed rezoning,subject to the conditions set
forth herein,enables the use and integration of contemporary land
planning principles in such a manner to promote its most appropriate
use and ensure residential land use densities that are in compliance
with the 1999 City of Apache Junction General Plan.
NOW,THEREFORE,BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF
THE CITY OF APACHE JUNCTION,ARIZONA THAT:
SECTION I:IN GENERAL
The zoning district classification on the Zoning District Map,City of
Apache Junction,Arizona,for the parcels of land legally described as:
Lots 48,49,50,51,52,Palm Springs Unit 5,according
to the Plat of record in the office of the County Recorder
of Pinal County,Arizona,in Book 13 of Maps,Page 55.
Also known as Pinal County Assessor Parcel Numbers
100-23-048,100-23-049,100-23-050,100-23-051,
and 100-23-052.
Be and hereby amended from CB -1 (Local Business Zone)to CR-3/PD
ORDINANCE NO.1241

(Single -Family Residence Zone.7000 square foot lots by Planned
Development),subject to the following conditions:
1)Except as conditioned herein,all standard provisions
of the CR-3 base zoning district apply.
2)The setbacks for lot 52 shall be twenty feet (20')in
the front yard,twenty feet (20')in the rear yard,
ten feet (10')in the street side yard,and five feet
(5')in the interior side yard.
3)Each lot shall be furnished with a front yard landscape
package with plant quantities to include:one (1)tree,
five (5)shrubs,and fifty (50)square feet of vegetative
ground cover.
4)Heating,ventilating;and air conditioning units ("HVAC")
shall be groyndmounted and screened from the street.
5)The formation of a key lot is prohibited.
6)The dwellings shall be painted with southwestern color
tones as defined by the City of Apache Junction Design
Guidelines.Two adjacent dwellings may not have the
same color palette.
SECTION II:REPEALING ANY CONFLICTING PROVISIONS
All ordinances and parts of ordinances in conflict with the provisions
of this ordinance are hereby repealed.
SECTION III:PROVIDING FOR SEVERABILITY
If any section,sub -section,sentence,phrase,clause or portion of
this ordinance,or any part of the code adopted herein by reference,is
for any reason held to be invalid or unconstitutional -by the decision
of any court of competent jurisdiction,such decision shall not affect
the validity of the remaining portions thereof.
