AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE
JUNCTION,ARIZONA,AMENDING THE APACHE JUNCTION CITY CODE.CHAPTER
2 MAYOR AND COUNCIL,ARTICLE 2-4 COUNCIL PROCEDURE,SECTION 2-4-6
ORDER OF BUSINESS,PERTAINING TO TIME ALLOWED FOR SPEAKERS AT CALL
TO THE PUBLIC AND PUBLIC HEARINGS;REPEALING ANY CONFLICTING
PROVISIONS;AND PROVIDING FOR SEVERABILITY.
WHEREAS,on June 21,2005,the Mayor and City Council unanimously
directed staff to research the policies and practices of other governmental
jurisdictions regarding the amount of time allotted for speakers at Call to the
Public and during Public Hearings and the location of Call to the Public on
their respective agendas;and
WHEREAS,on July 19,2005,the Mayor and City Council directed staff to
proceed with preparing an ordinance that would amend the Apache*Junction City
Code by revising the time allotted for speakers at Call to the Public and
Public Hearings.
NOW.THEREFORE,BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY
OF APACHE JUNCTION,ARIZONA,THAT:
SECTION I.IN GENERAL
1.That the Apache Junction City Code,Chapter 2 Mayor and Council,.Article
2-4 Council Procedure,Section 2-4-6 Order of Business,Subsection G.
Call to the Public and Subsection H.Public Hearings,be amended to read
as follows:-
G.Call to the Public.At this time the council shall,as it deems
necessary,consider all business,not specifically provided for herein.
Requests,petitions;..remonstrances, -communications,comments or
suggestions from citizens present shall be heard.All speakers must
submit a written "Request to Speak"form to the city clerk in advance of
this item.All such remarks shall be addressed to the council as a whole
and not to any'member thereof.Such remarks shall be limited to three
minutes unless additional time is granted by the mayor.Where 0 group or
organization wishes to present comments or discussion,one person from
the group shall be designated to present said comments or discussion.No
person other than the individual speaking shall enter into the discussion
without the permission Of the presiding officer.

H.Public Hearings.Public hearings required by city ordinance,state
statute or federal regulations shall be conducted by the council and all
interested parties given the opportunity to speak.If requested by any
aggrieved party.any member of the public or any member of the council,
or i f no public hearing has been held by the planning and zoning
commission,public hearings shall be conducted on amendments to the
zoning ordinance.All such remarks shall be addressed to the council as
a whole and not to any member thereof.Such remarks shall be limited to
five minutes unless additional time is granted by the mayor.This time
limitation shall not apply to applicants and their agents appearing
before the council.
SECTION II.REPEALING ANY CONFLICTING PROVISIONS
All ordinances and parts of ordinances in conflict with the provisions of
this ordinance or any part of.the code adopted herein by reference are
hereby repealed.
SECTION III.PROVIDING FOR SEVERABILITY
I f any section .,subsection,sentence,phrase,clause or portion of this
ordinance,or any part of the code adopted herein by reference is for any
reason held to be invalid or unconstitutional by the decision of any court of
competent jurisdiction',such decision shall not affect the validity of the
remaining portion thereof.
