HomeMy WebLinkAboutORD1247ORDINANCE NO.1247 AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,ARIZONA,AMENDING THE APACHE JUNCTION, ARIZONA,ZONING ORDINANCE,BY AMENDING THE ZONING DISTRICT MAP,CITY OF APACHE JUNCTION,ARIZONA,CHANGING THE ZONING DISTRICT CLASSIFICATION IN REZONING CASE PZ-16-05 FROM CR-3 (CONVENTIONAL SINGLE-FAMILY HOMES ON 7,000 :SQUPAE5 FOOT MINIMUM LOTS)TO CR-3/PD (CONVENTIONAL SINGLE -FAMILY -HOMES ON 7,000 SQUARE FOOT MINIMUM LOTS BY PLANNED DEVELOPMENT); REPEALING ANY CONFLICTING PROVISIONS:AND PROVIDING FOR SEVERABILITY. WHEREAS,on August 23,2005,the Apache Junction Planning and Zoning Commission,unanimously voted 6 to 0 to recommend approval of the request for rezoning,Case PZ-16-05,to change the zoning district classification from CR-3 to CR-3/PD;and WHEREAS.the Commission's recommendation contains specific conditions which the City Council hereby determines to provide greater flexibility in site design,pedestrian,and automotive traffic circulation,and encourages a more creative design compatible with existing and proposed land uses in the vicinity of the property in question;and WHEREAS,the City Council hereby determines that the proposed rezoning conforms to all of the general criteria' as specified in Section 19.0109,including compliance with the General Plan, integration with the surrounding neighborhood,adequate traffic accommodation,adequate public facilities,existing infrastructure, and that the design and uses should result in enhancement of the social,built,and natural environment in the City. BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,ARIZONA THAT: SECTION I:IN GENERAL The zoning district classification on the Zoning District Map,City of Apache Junction,Arizona,for the parcel of land legally described as: ORDINANCE NO.1247 PAGE 1 OF 3 Sonoran Wells Subdivision,Lots 1 through 33,as Recorded in the Office of the County Recorder, Pinal County,Arizona,Cabinet F,Slide 33; be and hereby is amended from CR-3 (Conventional Single -Family Homes on 7,000 square foot minimum lots)to CR-3/PD (Conventional Single -Family Homes on 7,000 square foot minimum lots by Planned Development); subject to the following stipulations: 1)The setbacks for lots 1,7,9,13,14,19,20,and 23 shall be: Front yard -20 feet Side yards -5 feet Rear yard -20 feet 2)Except as conditioned herein,all standard provisions of the CR-3 base zoning district apply. 3)Conditions of approval,numbers 1 through 11 of Ordinance No.1152,are still in full force and effect. 4)The side yard setbacks for lots 2,6,8,10,12,15,18,21, 22,and 24 abutting lots 1,7,9,13,14,19,20,and 23 shall be no less than 10 feet. SECTION II:REPEALING ANY CONFLICTING PROVISIONS All ordinances and parts of ordinances in conflict with the provisions of this ordinance are hereby repealed. SECTION III:PROVIDING FOR SEVERABILITY If any section,subsection,sentence phrase clause or portion of this ordinance,or any part of the code adopted herein by reference,is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction,such decision shall not affect the validity of the remaining portions thereof.
