AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE
JUNCTION.ARIZONA.AMENDING THE CITY OF APACHE JUNCTION PERSONNEL
RULES.RULE 8.ATTENDANCE AND LEAVES.AND RULE 9.OVERTIME:
REPEALING ANY CONFLICTING PROVISIONS:PROVIDING FOR SEVERABILITY:
AND DECLARING AN EMERGENCY.
WHEREAS,the workloads of.many City employees have increased due to
economic growth in the city and eMployee.turnover:and
WHEREAS.many employees due to their large workloads and work schedules are
unable to exhaust their vacation and/or compensatory time:and
WHEREAS,the current Personnel Rbles'provide limited managerial flexibility
relating to the use of accrued vacation time and compensatory time:and
WHEREAS.allowing money conversion and extended accrual levels of vacation
and compensatory time under the current employee caseloads and work schedules
would improve employee morale and would enhance the working relationships among
staff and the general public.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE
JUNCTION.ARIZONA.AS FOLLOWS:
SECTION I.IN GENERAL
1.That the City of Apache Junction Personnel Rules,Rule 8.Attendance and
Leaves.Section 2.Annual Vacation Leave,be amended with the following
additional paragraph after the existing operative language,to read as
follows:
The City Manager is authorized to direct the Finance Director to
convert any employee's vacation time over 320 hours accrued
retroactively from January 1.2004 to January 1.2005 and
retroactively from January 1,2005 to January 1.2006,to the
corresponding dollar value based on the employee's hourly rate
times the number of accrued hours,payable to the employee as
directed by the City Manager.
2.That the City of Apache Junction Personnel Rules,Rule 9.Overtime.
Section 9.Compensatory Time in Lieu of Overtime Payment,replacing
Paragraphs 4 and 7 in their entirety.be amended,to read as follows:

Paragraph 4:
Non-exempt employees may receive time off in lieu of overtime pay
for hours worked beyond 40 hours in a .seven-day work week.
Employees may accrue a maximum of 160 hours Of compensatory time
(106.67 actual hours of overtime worked).
Paragraph 7
Compensatory time may be .banked,used or converted into the
corresponding dollar amount at the employee's current pay rate in
accordance with the provisions of this policy.Employees who change
from one pay range to another,either by promotion or demotion.
shall be required to make such conversion before transitioning into
the new position.
SECTION II.REPEALING ANY CONFLICTING PROVISIONS
All ordinances and parts of ordinances in conflict with the provisions of
this ordinance or any part of the code adopted herein by reference are
hereby repealed.
SECTION III.PROVIDING FOR SEVERABILITY
I f any section.subsection, :,sentence,phrase.clause or portion of this
ordinance,or any part of the code adopted herein by reference is for any reason
held to be invalid or unconstitutional by the decision of any court of competent
jurisdiction,such decision shall not affect the validity of the remaining
portion thereof.
SECTION IV.DECLARING AN EMERGENCY
The immediate operation of the provisions of this ordinance is necessary for the
immediate preservation of the public peace,health or safety,and that an
emergency is hereby declared to exist:and that this ordinance shall be in full
force and effect from and after its passage,adoption and approval by the Mayor
and Council of the City of Apache Junction.See State v.City of Prescott.173
