AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF
APACHE JUNCTION,ARIZONA,AMENDING THE APACHE JUNCTION,
ARIZONA,ZONING ORDINANCE,BY AMENDING THE ZONING DISTRICT
MAP,CITY OF APACHE JUNCTION,ARIZONA,CHANGING THE ZONING
DISTRICT CLASSIFICATION IN REZONING CASE PZ-22-04 FROM GR
(GENERAL RURAL)TO CR-3/MH/PD (SINGLE FAMILY RESIDENCE ZONE
ALLOWING MANUFACTURED HOMES BY PLANNED DEVELOPMENT);REPEALING
ANY CONFLICTING PROVISIONS;AND PROVIDING FOR SEVERABILITY.
WHEREAS,on February 22,2005,the Apache Junction Planning and
Zoning Commission voted unanimously (6 to 0)to recommend approval of
rezoning request PZ-22-04:and
WHEREAS,the Commission's recommendation contained conditions
which the City Council hereby determines to provide greater flexibility
in land use and encourages 'a more creative design compatible with
existing and proposed land uses in the vicinity of the property in
question:and
WHEREAS,the proposed rezoning subject to the conditions set
forth herein enables the use and integration of contemporary land
planning principles in such a manner to promote its most appropriate
use,and further allows diversification in the relationship of various
uses,structures,and spaces.
NOW,THEREFORE,BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF
THE CITY OF APACHE JUNCTION,ARIZONA THAT:
SECTION I:IN GENERAL
The zoning district classification .onthe .,Zoninq District Map,City of
Apache Junction,Arizona,for the parcels .of land le'gally described as:
Parcel 1:
Lot 2,Block 7,Pueblo Del Sol according to the plat of record

in the office of the Pinal County Recorder of Pinal County,
Arizona,Book 9 of Maps,Page 4:and
The South 15 feet of Lot 1,Block 7.. Pueblo Del Sol according to
the plat of record in the office, of the Pinal County Recorder of
Pinal County,Arizona,Book 9 of-Maps,Page 4.
Also known as Pinal County: Assessor Parcel Number 101,705-068.
Parcel 2:
Lot 1,Block 7,Pueblo Del Sol according to the plat of record in
the office of the Pinal County Recorder of Pinal County,Arizona,
Book 9 of Maps,Page 4: _
Except
The South 15 feet thereof.
Also known as Pinal County Assessor Parcel Number 101-05-067A,
is amended from GR (General Rural)to CR-3/MH/PD (Single Family
Residence Zone allowing Manufactured Homes by Planned Development),
subject to the following conditions:
1.Except as conditioned herein,all other standard provisions
of the CR.-3/MH base zoning district apply to these lots
including,but not limited to:setbacks,permitted principle
uses,permitted accessory uses,building height.and lot
coverage.
2.Any changes to lot size,width,area or any lot line
adjustments or combinations shall require a Planned
Development Major Amendment.
3.Any future development on the subject lots shall meet the
CR-3/MH base zoning requirements.
4.Any site related non -conformity on parcel 101-05-067A shall

be subject to Section 3.0104 -3.0108 (Non -Conforming Use
Regulations)of the Zoning Ordinance.
SECTION II:REPEALING ANY CONFLICTING PROVISIONS:
All ordinances and parts of ordinances in conflict with the provisions
of this ordinance are hereby repealed.
SECTION III:PROVIDING FOR SEVERABILITY:
If any section,sub -section,sentence,phrase,clause or portion of
this ordinance,or any part of the code adopted herein by reference,is
for any reason held to be invalid or unconstitutional by the decision
of any court of competent jurisdiction,such decision shall not affect
the validity of the remaining portions thereof.
