AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF
THE CITY OF APACHE JUNCTION, ARIZONA, AMENDING
THE APACHE JUNCTION, ARIZONA, ZONING ORDINANCE,
BY AMENDING THE ZONING DISTRICT MAP, CITY OF
APACHE JUNCTION, ARIZONA,CHANGING THE ZONING
DISTRICT CLASSIFICATION IN REZONING CASE PZ-14-06,
A REQUEST BY E -BUILT CONTRACTING REPRESENTED BY
PRESTON STAPLEY AND KIM EATON, FROM TRAILER HOME
SITE (TH) TO MULTI -FAMILY RESIDENCE ZONE/TOWNHOMES
BY PLANNED DEVELOPMENT (CR-5/PD); REPEALING ANY
CONFLICTING PROVISIONS; AND PROVIDING FOR
SEVERABILITY.
WHEREAS, on November 28, 2006, the Apache Junction
Planning and Zoning Commission voted unanimously (7 to 0)
to recommend approval of rezoning request Case PZ-14-06;
and
WHEREAS, the Mayor and City Council hereby determine
that the proposed rezoning conforms to all of the general
criteria as specified in Section 19.0109 of the Zoning
Ordinance,including compliance with the General Plan,
integration with the surrounding neighborhood, adequate
traffic accommodation, adequate public -facilities,
extension of infrastructure, and that the design and uses
should result in enhancements to the social, built, and
natural environments in the City.
NOW THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY
COUNCIL OF APACHE JUNCTION, ARIZONA, AS FOLLOWS:
SECTION I:IN GENERAL
The zoning district classification on the Zoning District
Map, City of Apache Junction, _Arizona,for the parcel of
land legally described as:
The South half of the West half of the Southwest
quarter of the Southwest quarter of the Northwest
quarter of Section 30, Township 1 North, Range 8 East,
EXC North 75 feet of West 140 feet, EXC South 175.09
feet of West 198.91 feet, EXC South 40 feet as

conveyed in Docket 1987, Page 765-769, Section 30,
Township 1 North, Range 8 East, 1.32 Acres, Pinal
County, Arizona,
be and hereby is amended from TH to CR-5/PD subject to the
following conditions of approval:
1)Abundant landscaping for the perimeter of the subject
parcel, especially for the north, south and east
sides.Landscaping shall include natural desert
landscaping that represents the desert environment and
requires minimal maintenance.Landscaping will
improve the aesthetics of the structures and mitigate
the issues with height.Twenty-four inch (24") box
trees shall be planted along the north, east and south
sides buffering the property.
2)The retention basins 'shall include turf in the
retention basin in the northeast corner and shall
include a playground and picnic area for the enjoyment
of the residents.
3)The playground shall include a minimum of six (6) play
station points.Generally, each individual activity
equals one play station point.Also, the playground
equipment •manufacturer dictates the number of points.
4)The proposed units shall: A) be a minimum of fourteen
hundred square (1400 2) feet in size; B) include
southwestern architectural features as illustrated in
the City's design guidelines; and C) offer ground-
mounted air conditioning units and architectural
treatments on all fOur.(4) sides'of the building so as
to preclude flat or blank facades, including pop -outs
and roofline and color variations to add visual
interest.
5)Additional parking for guests shall be included.
According to Ordinance No. 1218, a minimum of one
guest parking space is required for each dwelling
unit.
6)Street improvements are not required along 16th Avenue,
but the right-of-way shall be reserved, be partially

landscaped and maintained by the established Home
Owner's Association until such time as the City
constructs the road.Street improvements with curb,
gutter, sidewalk, and streetlights are required along
Meridian Drive.
7)Mitigation measures for storm water drainage will be
-de'scribed and implemented by engineering review during
the plat submittal process.
8)This townhome development shall be open to all
families.
9)The height of the structures shall not exceed thirty
-feet (30').
10)The setbacks from the property line to the buildings
shall not be less than twenty feet (20').
11)The applicants shall disclose to prospective buyers
that there is neighboring horse property.
SECTION II:REPEALING ANY CONFLICTING PROVISIONS
All ordinances and parts of ordinances in conflict with the
provisions of this ordinance are hereby repealed.
SECTION III:PROVIDING FOR SEVERABILITY
If any section, sub -section, sentence, phrase, clause or
portion of this ordinance, or any part of the code adopted
herein by reference, is for any reason held to be invalid
or unconstitutional by the decision of any court of
competent jurisdiction, such decision shall not affect the
validity of the remaining portions thereof.
