AN ORDINANCE OF. THE MAYOR AND CITY COUNCIL OF THE
CITY OF APACHE JUNCTION,ARIZONA,AMENDING THE
APACHE JUNCTION,ARIZONA,ZONING ORDINANCE,BY
AMENDING THE ZONING DISTRICT MAP,CITY OF APACHE
JUNCTION,ARIZONA,CHANGING THE ZONING DISTRICT
CLASSIFICATION IN REZONING CASE PZ-1-07,FROM GR
(GENERAL RURAL)TO CR-3/PD (CONVENTIONAL SINGLE
FAMILY HOMES BY A PLANNED DEVELOPMENT) AND TO
R-1/PD (DUPLEX .ZONE BY A PLANNED DEVELOPMENT);
REPEALING ANY CONFLICTING PROVISIONS;AND
PROVIDING FOR SEVERABILITY.
WHEREAS,on February 27,2007,the Apache Junction
Planning and Zoning Commission voted to recommend approval
of the proposed rezoning request Case PZ-1-07, by a vote of
6 to 0,subject to the conditions of approval listed in
this ordinance; and
WHEREAS,the City Council hereby determines that the
proposed rezoning conforms to all of the applicable
criteria as specified in the City of Apache Junction Zoning
Ordinance,Article 19 Planned Development Zoning District,
Section 19.0109 General Criteria,and is in compliance with
the General Plan,integrates with the surrounding
neighborhood,adequately accommodates traffic,will have
adequate public facilities, .and that the .design and uses
should result in enhancement to the social,built,and
natural environment in the City.
NOW, THEREFORE, be it ordained by the Mayor and City
Council of the City of Apache Junction, Arizona, that:
SECTION I:IN GENERAL
The zoning district classification on the Zoning District
Map,City of Apache Junction,Arizona,for the parcel of
land legally described as:

Apache Homes lot 1,
be and hereby is amended from GR (General Rural) to CR-3/PD
(Conventional Single -Family Residences by Planned
Development)and to R-1/PD (Duplex Zone by Planned
Development)subject to the following conditions of
approval:
1)A land split is required for the creation of the two
lots prior to issuance of a building permit and the
development of said lots shall be in substantial
compliance with the conceptual site plans proposed
with Case PZ-1-07.
2)The proposed house shall be a minimum of one thousand
nine hundred (1,900) livable square feet in size,
shall include southwestern architectural features as
illustrated in the City's Design Guidelines, air
conditioning units shall be ground mounted, and
architectural treatments on all four sides of the
building are required, including pop -outs, roof line,
and color variations to add visual interest to
preclude flat or blank façades.
3)All standard provisions for CR-3 and R-1 shall be
applied to the proposal; all standard setbacks shall
be met and the resultant lots shall also be improved
with perimeter walls.
4)The existing duplex shall be improved with no less
than a 3 vehicle carport which matches the colors of
the duplex, for the occupants currently residing on
the 'west, side' of'the.property.An additional
improvement of 2 inch .(2") asphalt or a native
concrete driveway shall be required to reach the
carports.
5)Front yard xeriscape landscape packages shall be
provided with the development of the lots.This
includes.S minimum of two (2) twenty-four inch (24")
box trees, ,four (4) five (5) gallon shrubs and

groundcover and decomposed granite as specified in
the City of Apache Junction Landscape and Screening
Requirements.
6)All applicable permits -shall be applied for and plans
shall be designed to current City codes prior to any
building removal, lot grading or construction on the
lots.All applicable development fees shall be paid
at the time of building permits issuance.
SECTION II:REPEALING ANY CONFLICTING PROVISIONS
All ordinances and parts of ordinances in conflict with the
provisions of this ordinance are hereby repealed.
SECTION III:PROVIDING FOR SEVERABILITY
If any section,sub -section,sentence,phrase,clause or
portion of this ordinance, or any part of the code adopted
herein by reference,is for any reason held to be invalid
or unconstitutional by the decision of any court of
competent jurisdiction,such decision shall not affect the
validity of the remaining portions thereof.
