HomeMy WebLinkAboutORD1298ORDINANCE NO. 1298 AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,ARIZONA,AMENDING THE APACHE JUNCTION CITY CODE,VOLUME II,LAND DEVELOPMENT CODE,CHAPTER 1,ZONING ORDINANCE,BY AMENDING ARTICLE 21 SIGNS, BILLBOARDS, NAMEPLATES, OTHER OUTDOOR ADVERTISING;ADOPTING "AMENDMENTS TO APACHE JUNCTION CITY CODE,VOLUME II,CHAPTER 1, ZONING ORDINANCE,ARTICLE 21 SIGNS,BILLBOARDS, NAMEPLATES,OTHER OUTDOOR ADVERTISING"BY REFERENCE;REPEALING ANY CONFLICTING PROVISIONS; PROVIDING FOR SEVERABILITY;AND PROVIDING FOR PENALTIES. WHEREAS, the existing sign regulations for the City of Apache Junction do not directly address freeway oriented signs; and WHEREAS, the City Council previously directed staff to study the issue of allowing taller and larger freeway signs; and WHEREAS,new regulations allowing taller and larger signs along the U.S. 60 freeway corridor will encourage new commercial development in the City; and WHEREAS, the Planning and Zoning Commission, at their meeting of March 27,2007,unanimously recommended in favor of allowing taller and larger freeway signs subject to certain provisions in Case No. AM -7-04; and WHEREAS, A.R.S. § 9-802 permits mundcipalities to enact the provisions of a code or public record theretofore in existence without setting forth such provisions in full text as long as the adopting ordinance is published in full text and at least three copies of the code or public record are filed in the office of the clerk of the municipality and are made available for public use and inspection; and WHEREAS, pursuant to A.R.S. §.§ 9-801(1) and 9-802, codes which may be adopted by reference include those relating to zoning ordinances, including those for signs, billboards, nameplates, and other outdoor advertising; and WHEREAS,City staff has deterMined: that for administrative efficiency, it is more appropriate to update the zoning ordinances for signs billboards, nameplates, and other outdoor advertising by amending Article 21. ORDINANCE NO. 1298 PAGE 1 OF 3 NOW, THEREFORE, BE IT ORDAINiM. BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA, AS FOLLOWS SECTION I IN GENERAL 1. That existing Apache Junction City Code; Volume II,Land Development Code,Chapter 1, :Zoning Ordinance,Article 21 Signs, Billboards, Nameplates, Other Outdoor Advertising,is hereby amended. 2. That certain document known as 'Amendments to Apache Junction City Code, Volume IL, Chapter 1,Zoning Ordinance, Article 21 Signs, Billboards, Nameplates, Other Outdoor Advertising,"three copies of which are on file in the office of the City Clerk, which document was made a public record by Resolution No. 07-24 of the City of Apache Junction, is hereby referred to, adopted and made a part hereof as if fully set out in this ordinance, pursuant to A.R.S. § 9-802. SECTION II REPEALING ANY CONFLICTING ORDINANCES All ordinances and parts of ordinances in conflict with the provisions of this ordinance or any part of the codes adopted herein by reference are hereby repealed. SECTION III PROVIDING FOR SEVERABILITY If any section, subsection, sentence, phrase, clause or portion of this ordinance or any part of the codes or regulations adopted herein by reference is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions thereof. SECTION IV PROVIDING FOR PENALTIES After the City exhausts all of its civil violation procedures as referenced in the adopted regulations,any violation of any provisions adopted herein,shall be punishable as a Class 1 Misdemeanor consistent with Apache Junction City Code, Chapter 1, GENERAL,Article 1-8 PENALTY. AMENDMENTS TO APACHE JUNCTION CITY CODE, VOLUME CHAPTER 1, ZONING ORDINANCE, ARTICLE 21 SIGNS, BILLBOARDS, NAMEPLATES, OTHER OUTDOOR ADVERTISING AMENDED SECTIONS SECTION 21.03 DEFINITIONS SECTION 21.16 GENERAL PROVISIONS SECTION 21.27 PERMITTED SIGNS BY ZONING DISTRICT SECTION 21.28 PERMITTED SIGNS BY ZONING DISTRICT Section 21.03 Definitions,shall be amended as follows: CHANGING MESSAGE SIGN shall mean any sign with an electronic display that contains a stationary message which may be changed at a minimum interval of once every 6-10 seconds.This message must change immediately and no continuous traveling or scrolling displays are allowed. DETACHED SIGN shall mean any sign supported wholly by the ground or by a structure in the ground (pole sign).Maximum height shall be twelve feet (12')as measured from the existing road grade or twenty-five feet (25') above adjacent freeway grade for properties adjacent to the freeway.(See Sections 21.22.h, 21.27, and 21.28 for further regulations.) PYLON SIGN shall mean a freestanding sign with visible support structure, with the support structure enclosed with a pole cover or enclosed in some architectural feature. SECTION 21.16 General Provisions,shall be amended to add the following language: Changing message signs shall be allowed as a portion of an approved freeway oriented pylon sign provided that: a.Changing message signs are only permitted on freeway oriented pylon signs. b.The total area for the changing message sign must be counted toward the total allowed area for a freeway pylon sign. c.The changing message display is not the dominant feature of the pylon sign.The business trademark or 1 name must be a permanent and prevailing feature on the sign. d.The changing message display shall have a maximum area of eighty (80)square feet.In addition an electronic pricing sign shall be limited to sixteen (16)square feet. e.Any changeable message must be directly related to the business or businesses conducted on site. f.Messages may be changed at a minimum interval of once every 6-10 seconds.Any change must take place instantly,with no scrolling or continuous traveling allowed. Subsection "a"of SECTION 21.22 shall be amended to read as follows: In no case shall any sign: a.Be animated,audible,rotate,or have intermittent or flashing illumination.Exempt from this provision are electronic public message changes and changing message signs as allowed by Section 21.16. SECTION 21.27 Permitted Signs by Zoning District,shall be amended as follows: Commercial Districts:Within the commercial districts,signs indicating the business, commodities, service, or other activity sold,offered or conducted on the premises are permitted as follows: a.One (1) detached sign for each developed lot or parcel, not exceeding one (1)square foot of sign area for each lineal foot of street frontage abutting the developed portion of said parcel or lot, provided that: 1)Detached signs shall be a maximum of twelve feet (12') in height.(See definition for additional requirements and SECTION 21.27 letters e and f for exceptions). 2)No detached sign shall exceed a total area of two hundred (200) square feet per sign face. 2 3)Detached signs shall legibly display the address number of the business or project. The area of the address shall not be deducted from the allowable sign area. b.An occupancy with one -hundred feet (100')or less of building frontage shall be allowed four (4) attached signs. Signs shall not exceed two (2) square feet of sign area for each front foot of building occupancy.Said signs may be roof or wall -mounted,on or under an architectural projection.At least one attached sign per project shall legibly display its address number, the area of which shall not be deducted from the allowable sign area. c.An occupancy with more than one -hundred feet (100')of building frontage shall be allowed eight (8)attached signs.Signs shall not exceed two (2)square feet of sign area for each front foot of building occupancy.Said signs may be roof or wall -mounted,on or under an architectural projection. No attached sign shall exceed two -hundred (200) square feet in total area. Total attached signage shall not exceed four -hundred (400)square feet.At least one (1) attached sign per project shall legibly display its address number,the area of which shall not be deducted from the allowable sign area. d.Each occupancy shall be allowed at least thirty-two (32) square feet of total sign area. e.For properties with a minimum of six -hundred sixty feet (660')of direct freeway frontage,one pylon sign oriented toward the freeway provided that: 1)Maximum height of pylon signs shall be twenty-five feet (25')above grade of the closest freeway travel lane. 2)Maximum sign width shall be twenty feet (20'). 3)Maximum sign area for a single tenant sign shall be one -hundred sixty (160) square feet. 4)An additional forty (40)square feet of sign area shall be allowed for architectural embellishments on single tenant signs with an architectural character similar to the main structure and consistent with the City of Apache Junction Design Guidelines. 3 Architectural character must be utilized for the entire sign and not just the support structure. f.For properties with less than six -hundred sixty (660)feet of direct freeway frontage: 1)Multi -tenant sign may be used for multiple properties with a combined freeway frontage of six -hundred sixty (660)feet.A comprehensive sign package must be submitted to the City for all properties using a multi -tenant sign.(See Figure). SECTION 21.28 Permitted Signs by Zoning District,shall be amended to read as follows: 4 Industrial Districts:Signs indicating the business, commodities,service,or other activity sold,offered or conducted on the premises are permitted as follows: a.One (1) detached sign for each developed lot or parcel, not exceeding one (1)square foot of sign area for each lineal foot of street frontage abutting the developed portion of said parcel. 1)Detached signs shall be a maximum of twelve feet (12') in height.(See definition for additional requirements and SECTION 21.28 letters c and d for excepticins). 2)Detached signs erected in the industrial district shall not exceed a total area of two -hundred (200) square feet per sign face. 3)Detached signs shall legibly display the address number of the business or project,the area of which shall not be deducted from the allowable sign area. b.Two (2) attached signs for each occupancy.
