HomeMy WebLinkAboutORD1256ORDINANCE NO.1256 AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,ARIZONA,AMENDING THE APACHE JUNCTION, ARIZONA,ZONING ORDINANCE.BY AMENDING THE ZONING DISTRICT MAP,CITY OF APACHE JUNCTION,ARIZONA,CHANGING THE ZONING DISTRICT CLASSIFICATION IN REZONING CASE PZ-21-05,FROM GR (GENERAL RURAL)TO CR-3/PD (CONVENTIONAL SINGLE-FAMILY RESIDENCES BY PLANNED DEVELOPMENT);REPEALING ANY CONFLICT- ING PROVISIONS;AND PROVIDING FOR SEVERABILITY. WHEREAS.on November 22,2005.the Apache Junction Planning and Zoning Commission voted unanimously (5 to 0)to recOmmend approval of rezoning request PZ-21-05,subject to the conditions of approval listed in this ordinance,but did not recommend approval of a specific development concept plan for the property:and WHEREAS.the City Council hereby determines that the proposed rezoning conforms to all of the applicable criteria as specified in the City of Apache Junction Zoning Ordinance,Article 19 Planned Development Zoning District.Section 19.0109 General Criteria,and complies with the General Plan,integrates with the surrounding neighborhood,adequately accommodates traffic,will provide adequate public facilities,and that the design and uses should result in enhancement to the social,built,and natural environment in the City. NOW,THEREFORE,be it ordained that: SECTION I:IN GENERAL .. The zoning district classification on the Zoning District Map,City of Apache Junction,Arizona,for theparcel of land legally described as: The North Half of the Southeast Quarter of the Northwest Quarter of the Southwest •Quarter of Section 27,Township 1 North.Range 8 East of the Gila and Salt River Base and Meridian,Pinal County. Arizona: be and hereby is amended from GR (General Rural)to CR-3/PD ORDINANCE NO.1256 PAGE 1 OF 3 (Conventional Single -Family Residences by Planned Development)subject to the following conditions of approval: 1)The preliminary subdivision plat shall feature lot sizes no less than 7.000 square feet in size. 2)The preliminary subdivision plat shall feature pedestrian connections to adjoining neighborhoods or developments subject to the approval of the Planning and Zoning Commission. 3)Prior to any future development on the 5 gross acres parcel. the developers shall dedicate and improve to the City Engineer's standards,any necessary rights -of -way,both internal and external to the site.Said improvements may include,but are not necessarily limited to,the provision of curbs,gutters. sidewalks,driveways,streetlights and retention basins. 4)Housing elevations shall contain color tone palettes and architectural features consistent with the City of Apache Junction Design Guidelines. 5)The Planning and Zoning Commission may waive or modify the provisions of the Landscape and Screening Requirements as necessary to ensure a creative design of any future subdivision proposal. 6)Heating,ventilation,and air conditioning (HVAC)units shall .be ground -mounted and not be visible from the public right-of-way or be located behind the main buildings. 7)Each lot shall be furnished with a front yard landscape package with plant quantities to include no less than 2 trees.7 shrubs,and 80 square feet of vegetative ground cover. 8)Except as otherwise conditioned herein,all standard provisions of the CR-3 base zoning district shall apply to any future subdivision proposal. 9)Home heights shall be limited to single story. ORDINANCE NO.1256 PAGE 2 OF 3 SECTION II:REPEALING ANY CONFLICTING PROVISIONS All ordinances and parts of ordinances in conflict with the provisions of this ordinance are hereby repealed. SECTION III:PROVIDING FOR SEVERABILITY If any section,sub -section.sentence,phrase,clause or portion of this ordinance,or any part of the code adopted herein by reference,is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction,such decision shall not affect the validity of the remaining portions thereof.
