AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF
APACHE JUNCTION.ARIZONA.AMENDING THE APACHE JUNCTION,
ARIZONA,ZONING ORDINANCE,BY AMENDING THE ZONING DISTRICT
MAP,CITY OF APACHE JUNCTION,ARIZONA,CHANGING THE ZONING
DISTRICT CLASSIFICATION IN REZONING CASE PZ-24-05,FROM GR
(GENERAL RURAL)TO CR-S/PD (MULTI -FAMILY RESIDENCES/
TOWNHOMES BY PLANNED DEVELOPMENT):REPEALING ANY CONFLICTING
PROVISIONS:AND PROVIDING FOR SEVERABILITY.
WHEREAS.on December.. 27,2005,the Apache Junction Planning and
Zoning Commission voted to recommend approval of the proposed rezoning
request PZ-24-05,by a vote of 5 to 1,subject to the conditions of
approval listed in this ordinance:and
WHEREAS.the City Council hereby determines that the proposed
rezoning conforms to all of the applicable criteria as specified in the
City of Apache Junction Zoning Ordinance,Article 19 Planned
Development Zoning District,Section 19.0109 General Criteria,and is
in compliance with the General Plan,integrates with the surrounding
neighborhood.adequately accommodates traffic,will have adequate
public facilities,and that the design and uses should result in
enhancement to the social.built,and natural environment in the City.
.NOW.THEREFORE,be it ordained that:
SECTION I:IN GENERAL
The zoning district classification on the Zoning District Map.City of
Apache Junction,Arizona,for the parcels of land legally described as:
Lots 2 and 3 of Apache Addition Acres,according to the plat of
record in the Office of the County Recorder of Pinal County,
Arizona,recorded in Book 5 of Maps.Page 32:except the west 17
feet thereof (also known as Parcels 101-15-019 and 101-15-020):
be and hereby are amended from GR (General Rural)to CR-5/PD (Multi-
Family Residences/Townhomes by Planned Development)subject to the
following conditions of approval:

1)The final plan.building layouts.and future subdivision
plat shall conform substantially with the submitted concept
plan in Case P7-24-05.
2)The final development plans shall comply with or exceed all
parking requirements for residents,guests and disabled
persons.
3)In accordance with the submitted conceptual landscape plan,
the final landscaping plan shall include trees of a twenty
four inch (24")box size and larger along the Ironwood Drive
frontage.Fifty percent (50%)of the proposed shrubs in the
front landscape area shall be 5 -gallon in size.All other
plantings and landscape materials in the frontage area shall
be installed in accordance with the conceptual landscape plan
and with the provisions of Article 6-1 Landscape and Screening
Requirements.
4)Twenty-four inch (24")box sizetrees shall also be provided
every thirty feet (30')along the north,east and south
property lines to provide a visual buffer to neighboring
properties.All other plantings and landscape materials in
the perimeter areas shall comply with Article 6-1 Landscape
and Screening Requirements.
5)The requirements of Sections 15.0605,15.0606.15.0607.and
15.0609 of the Zoning Ordinance are waived to the extent
necessary to permit the platting of the development as shown
in Case P7-24-05.
6)All buildings shall be designed in compliance with the concepts
contained in the City's Design Guidelines booklet:and all
buildings shall incorporate architectural features on all
exterior elevations which preclude the appearance of flat and/
or blank facades.
7)All open spaces,including retention areas and street
landscaping,shall be perpetually maintained by a homeowner's
association (HOA)which will be established to provide for
maintenance of the common areas and for enforcement of community
rules and regulations.

8)Except as noted herein,all other standard provisions of the
CR-5 zoning district shall apply to the proposed development.
9)All construction and on -site and off -site improvements shall
comply with all applicable City,County and State guidelines,
standards and codes,including fire and building codes,and
proper permits and inspections processes.
SECTION II:REPEALING ANY CONFLICTING PROVISIONS
All ordinances and parts of ordinances in conflict with the provisions
of this ordinance are hereby repealed.
SECTION III:PROVIDING FOR SEVERABILITY
If any section.sub -section,sentence,phrase,clause or portion of
this ordinance,or any part of the code adopted herein by reference.is
for any reason held to be invalid or unconstitutional by the decision
of any court of competent jurisdiction,such decision shall not affect
the validity of the remaining portions thereof.
