AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF
APACHE JUNCTION.ARIZONA.AMENDING THE APACHE JUNCTION.
ARIZONA,ZONING ORDINANCE,BY AMENDING THE ZONING DISTRICT
MAP,CITY OF APACHE JUNCTION,ARIZONA,CHANGING THE ZONI
DISTRICT CLASSIFICATION IN REZONING CASE P7-20-05,FRO
R1-43 (SINGLE-FAMILY RESIDENCE ZONE)TO R1-43/PD (SIJ1GLE
FAMILY RESIDENCE ZONE THROUGH PLANNED DEVELOPMENT),REPEALING
ANY CONFLICTING PROVISIONS:AND PROVIDING FOR S ERABILITY.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF TX CITY OF APACHE
JUNCTION,ARIZONA THAT:
SECTION I:IN GENERAL
That the zoning district classificatio9/on the Zoning District Map,City of
Apache Junction,Arizona,for the paceel of land legally described as:
Assessor Parcel Number 100Z'5-017,the North half of the
Southwest quarter of the orthwest quarter of the Northwest
quarter of Section 15 0/Township 1 North,Range 8 East.of
the Gila and Salt R1vØ Base and Meridian.Pinal County.
Arizona.5.00 acres
Assessor Parcel)'timber 100-25-006.the North half of the
Northeast quarpér of the Northwest quarter of the Northwest

Be and hereby is amended from ,R1-43 (Single -Family Residence Zone)to
R1-43/PD(Single-Family Residence by Planned Development).subject :to the
following conditions of approval:
1)The subdivision development shall provide for a mi imum
of five (5)model types.with 3 elevation varia ons each.
and four-sided architecture.
2)The final plan and future subdivision pla shall conform
substantially with the submitted and app oved concept plan.

3)A landscape plan prepqr'S by a egistered Landscape Architect

4)The developers shall pa/all applicable development fees
prior to the issuance ,6f building permits.

5)Within one year of reliminary plat approval,the applicants
shall submit for f rmal review a final subdivision plat.and
improvement plans/ for the proposed development.
6)Any use or dev:opment of said property is conditioned upon
the provision of public improvements,a decorative masonry
perimeter wa and landscaping in accordance with the landscape
and screeni g regulations of the City.and amendments thereto.
The provis'ons of the Uniform Building Code.Uniform Fire Code
(includins.but not limited to.the provision of sufficient
fire app ,,ratus access roads,the marking of fire lanes and the
provisic of adequate water supplies,and fire hydrants)and
all o er city codes,policies,guides.and standards shall
appl aid control all design and construction of improvements.

codes and ordinances,including the City of Apache Junction

Engineering Guidelines.
8)The open space.including retention areas and street
landscaping will be perpetually maintained by a Homee ,ners
Association.Said open space/retention areas shal not be
constructed upon,otherwise obstructed,or used •any
unapproved manner.Wrought iron view fencing :all be provided
around the retention and open space areas o the south side of
the proposed subdivision.
9)The development shall be constructed X meet at a minimum
Energy Efficient standards for EnvirAhmental Protection Agency
(EPA)Energy Star homes.

limited to ot buildable areas and usable space.Barns shall
be set back at least forty feet (40')from any property line.
14)The dev9ilopment's Covenants,Conditions and Restrictions shall
provid/ for lot equine cleanup and fly abatement.

15)A pl4A nt relocation plan shall be approved prior to the
pr iminary plat approval for relocation of any protected
n tive plants.
16)/ All utilities within the subdivision shall be located
underground.
SECTION II:REPEALING ANY CONFLETING PROVISIONS

All ordinances and parts of ordinances in conflict with the provisions of this
ordinance are hereby repealed.
SECTION III:PROVIDING FOR SEVERABILITY
If any section.subsection,sentence,phrase.clause or portion of this
Ordinance,or any part of the Code adopted herein by reference,'s for any
reason held to be invalid or unconstitutional by the decision /f any court of
competent jurisdiction,such decision shall not affect the ylidity of the
remaining portions thereof.
