HomeMy WebLinkAboutORD1266ORDINANCE NO.1266 AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,ARIZONA,AMENDING THE APACHE JUNCTION, ARIZONA,ZONING ORDINANCE,BY AMENDING THE ZONING DISTRICT MAP,CITY OF APACHE JUNCTION,ARIZONA,CHANGING THE ZONING DISTRICT CLASSIFICATION IN REZONING CASE PZ-2-06,FROM GENERAL RURAL ("GR")TO CONVENTIONAL SINGLE-FAMILY HOMES BY PLANNED DEVELOPMENT ("CR-3/PD"):REPEALING ANY CONFLICTING PROVISIONS: AND PROVIDING FOR SEVERABILITY.• WHEREAS,on February 28,2006,the Apache Junction Planning and Zoning Commission voted to recommend approval of the rezoning request Case PZ-2-06 by a vote of 5 to 0,subject to the conditions of approval listed in this ordinance;and WHEREAS,the City Council hereby determines that the proposed rezoning conforms to all of the applicable"criteria as specified in the City of Apache Junction Zoning Ordinance,Article 19 Planned Development Zoning District,Section 19,',0109 General Criteria,and is in compliance with the General Plan,integrates with the surrounding neighborhood,adequately accommodates traffic,will have adequate public facilities,and that the design and uses should result in enhancement to the social,built,and natural environment in the City. NOW,THEREFORE,be it ordained that: SECTION I:IN GENERAL The zoning district classification on the Zoning District Map,City of Apache Junction,Arizona,for the parcel of land legally described as: The East half of the South 118.42 feet of the North 922.89 feet of the West half of the West half of the Southeast quarter of the Southwest quarter of Section 19,Township 1 North,Range 8 East of the Gila and Salt River Base and Meridian,Pinal County,Arizona:EXCEPT for the East 25 feet thereof (also known as Pinal County Assessor Parcel Number 101-07-020;approximately .45 gross acres): ORDINANCE NO.1266 PAGE 1 OF 3 be and hereby is amended from GR to CR-3/PD subject to the following conditions of approval: 1)Street improvements,such as extension of pavement and the provision of sidewalk,curb,gutter,and streetlights,normally required for CR-3-zoned,7 000 net -square -foot minimum lots shall not be required as part of this planned development rezoning. 2)The future two lots shall be created through a land split process and the development of said lots shall be in sub- stantial compliance with the conceptual site plans proposed with Case PZ-2-06. 3)The proposed houses shall:a)be a minimum of 1,600 livable square feet in size:b)include southwestern architectural features as illustrated in the City's Design Guidelines: c)offer ground mounted air-conditioning units and architectural treatments on all four sides of the buildings so as to preclude flat or blank facades,including pop -outs and roofline and color variations to add visual interest. 4)Except for the allowance of 59 -foot -wide lots or other noted exceptions herein,all other standard provi ions of the CR-3 zone and the planned development zoning district shall apply to the development of the lots,including setbacks,lot sizes and the provision of perimeter masonry walls. 5)Front yard xeriscape landscape packages shall be provided with the development of the lots,to include a minimum of two 24 -inch box trees,four 5 -gallon shrubs and groundcovers and decomposed granite as specified in the City of Apache Junction Landscape and Screening Requirements. 6)All applicable permits shall be applied for and plans shall be designed to current City codes prior to any building removal, lot grading or construction on the lots.Inclusively,all applicable development fees shall be paid at the time of permit issuance. SECTION II:REPEALING ANY CONFLICTING PROVISIONS ORDINANCE NO.1266 PAGE 2 OF 3 All ordinances and parts of ordinances in conflict with the provisions of this ordinance are hereby repealed. SECTION III:PROVIDING FOR SEVERABILITY If any section,sub -section,sentence,phrase,clause or portion of this ordinance,or any part of the code adopted herein by reference,is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction,such decision shall not affect the validity of the remaining portions thereof.
