HomeMy WebLinkAboutORD1268ORDINANCE NO.1268 AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,ARIZONA,AMENDING THE APACHE JUNCTION, ARIZONA,ZONING ORDINANCE,BY AMENDING THE ZONING DISTRICT MAP,CITY OF APACHE JUNCTION,ARIZONA,CHANGING THE ZONING DISTRICT CLASSIFICATION IN REZONING CASE PZ-3-06,FROM TH (TRAILER HOMESITE ZONE)TO CR-4/PD (MULTI -FAMILY RESIDENCES/ COURT HOMES BY PLANNED DEVELOPMENT);REPEALING ANY CONFLICTING PROVISIONS;AND PROVIDING FOR SEVERABILITY. WHEREAS,on April 25,2006,the Apache Junction Planning and Zoning Commission voted to recommend approval of the proposed rezoning request PZ-3-06,by a vote of 5 to 0,subject to the conditions of approval listed in this ordinance;and WHEREAS,the City Council hereby determines that the proposed rezoning conforms to ,all of the applicable criteria as specified in the City of Apache Junction Zoning Ordinance,Article 19 Planned Development Zoning District:Section 19.0109 General Criteria,and is in compliance with the General Plan,integrates with the surrounding neighborhood,adequately accommodates traffic,will have adequate public facilities,and that the design and uses should result in enhancement to the social,built,and natural environment in the City. NOW,THEREFORE,be it ordained that: SECTION I:IN GENERAL The zoning district classification on the Zoning District Map,City of Apache Junction,Arizona,for the parcel of land legally described as: The West half of the following described property: North 660 feet of the Southwest quarter of Section 30, Township 1 North,Range 8 East,of the Gila and Salt River Base and Meridian,Pinal County,Arizona: EXCEPT the West 1980 feet thereof;AND EXCEPT Commencing at the center of said Section 30, which is a '4"diameter rebar located at the intersection of 16" Avenue and Delaware Road; ORDINANCE NO.1268 PAGE 1 OF 4 Thence South 89 degrees 55 minutes 40 seconds West,along the East-West midsection line of said Section 30,a distance of 651.13 feet; Thence South 0 degrees 01 minutes 47 seconds West,a distance of 460.00 feet to the Point of Beginning; Thence South 89 degrees 58 minutes 51 seconds East,a distance of 113.93 feet of a point on a non -tangent curve,concave Northeasterly having a radius of .50.00 feet and a radial bearing of 78 degrees 10 minutes 44 seconds; Thence Southeasterly along the arc of said curve,through a central angle of 98 degrees 40 minutes 26 seconds,a distance of 86.11 feet; Thence South 20 degrees 29 minutes 42 seconds East,a distance of 174.00 feet; Thence South 89 degrees 55 minutes 33 seconds West,a distance of 241.14 feet; Thence North 0 degrees 01 minutes 47 seconds East,a distance of 199.93 feet to the Point of Beginning; be and hereby is amended from TH (Trailer Homesite Zone)to CR-4/PD (Multi -Family Residences/Court Homes by Planned Development)subject to the following conditions of approval: 1)Street improvements,such as extension of pavement and the provision of sidewalk,curb,gutter,streetlights and fire hydrants;normally required.for CR-4 7zoned lots shall be .required as part of -this planned development rezoning. 2)The community ramada amenity shall be shaded for the mitigation of summer heat by drought -tolerant,low-water using trees.Specifically,either thirty-six inch (36")box Ironwoods or twenty-four inch (24")box Rio Salado Mesquites. The Ironwood representing the first choice as i t is slow growing and the Mesquite as a secondary option as i t is resistant to high winds and is a good shade tree. 3)The perimeter of the development adjacent to 16th Avenue shall be completely landscaped,with a maximum of 50% of the area set aside for retention applications.A decorative masonry wall shall also complement the 16th Avenue streetscape to reduce traffic noise and to screen the development from the road. ORDINANCE NO.1268 PAGE 2 OF 4 4)The proposed houses shall include southwestern architectural features as illustrated in the city's Design Guidelines, shall offer ground mounted air conditioning units and architectural treatments on all four sides of the buildings so as to preclude flat or blank facades,including pop -outs and roofline and color variations to add visual interest. 5)Front yard xeriscape landscape packages shall be provided with the development of the lots,to include a minimum of two twenty-four inch (24")box trees,four 5 -gallon shrubs and groundcovers and decomposed granite as specified in the City of Apache Junction Landscape and Screening Requirements. 6)All applicable permits shall be applied for and plans shall be designed to current city codes prior to any building removal;lot grading or construction on the lots. Inclusively,all applicable development fees shall be paid at the time of permits issuance. 7)The preliminary and final plats shall reflect substantial compliance and consistency with the Planned Development concepts presented with Case PZ-3-06,incorporated by reference herein, .00 as otherwise specified through these conditions of approval.. SECTION II:REPEALING ANY CONFLICTING PROVISIONS All ordinances and parts of ordinances in conflict with the provisions of this ordinance are hereby repealed. SECTION III:PROVIDING FOR SrVERABILITY If any section,sub -section,sentence,phrase,clause or portion of this ordinance,or any part of the code adopted herein by reference,is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction,such decision shall not affect the validity of the remaining portions thereof.
