AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE
CITY OF APACHE JUNCTION,ARIZONA,AMENDING THE
APACHE JUNCTION CITY CODE BY REPEALING CHAPTER 4
FEES,ARTICLE 4-4 PLANNING,ZONING,REVIEW AND
SUBDIVISION FEES AND ARTICLE 4-5,SPECIAL SIGN
PERMIT FEES;AND ADOPTING BY REFERENCE A NEW
CHAPTER 4 FEES,ARTICLE 4-4 DEVELOPMENT SERVICES
DEPARTMENT FEES;REPEALING ANY CONFLICTING
PROVISIONS;PROVIDING FOR SEVERABILITY;
ESTABLISHING AN EFFECTIVE DATE; AND PROVIDING FOR
PENALTIES.
WHEREAS, A.R.S. § 9-802 permits municipalities to enact the
provisions of a code or public record theretofore in existence
without setting forth such provisions in full text as long as
the adopting ordinance is published in full text and at least
three copies of the code or public record are filed in the
office of the clerk of the municipality and are made available
for public use and inspection; and
• WHEREAS,pursuant to A.R.S.§§ 9-801(1)and 9-802,public
records and codes which may be adopted by reference include fee
schedules relating to planning,zoning review,subdivision and
building permits as regulated by a municipality; and
WHEREAS, at the March 6, 2006 work session of the Mayor and
City Council,staff presented an;updateof the Building Safety
Codes,Building Safety Permit--"Fees and Development Services
Department Planning and Zoning Fees,including the addition of -
new fees tor services which no fees are currently being charged;
and
WHEREAS,the presentation included a.comparison of the
City's current building permit fees to other municipalities
including Queen Creek, Goodyear, Gilbert, Avondale, Glendale and.
Surprise; and
WHEREAS, research uncovered that the City's building permit
fees are approximately :sixty :percent .below the average as
charged by the above -noted municipalities; and

WHEREAS,staff believes the planning and zoning fees are
also well below the average fees charged in the Phoenix
metropolitan area; and
WHEREAS,staff recommends that all of the Development
Services Department Fees be increased to be more in line with
comparable cities and towns in the Phoenix metropolitan area.
NOW,THEREFORE,BE IT ORDAINED BY THE MAYOR AND CITY
COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA, AS FOLLOWS:
SECTION I IN GENERAL
1.That the existing Apache Junction City Code,Chapter 4,
Fees,Articles 4-4 Planning,Zoning Review,and
Subdivision Fees and Article 4-5 Special Sign Permit
Fees,are hereby repealed.
2.That certain document known as the "Apache Junction City
Code, Chapter 4 FEES and Article 4-4 Development Services
Department Fees,"three copies of which are on file in
the office of the City Clerk, which document was made a
public record by Resolution No.06-38 of the City of
Apache Junction,is hereby referred to, adopted and made
a part hereof as if fully set out in this ordinance,
pursuant to A.R.S. § 9-802.
SECTION II REPEALING ANY CONFLICTING ORDINANCES
All ordinances and parts of ordinances in conflict with the
provisions of this Ordinance or .any part of the codes adopted
herein by reference are hereby repealed.
SECTION III PROVIDING FOR.SEVERABILITY
If any section,subsection,sentence, phrase,clause or portion
of this ordinance or any part of the codes adopted herein by
reference is for any -reason held to be invalid or
unconstitutional by the decision of any court of competent
jurisdiction, such decision shall not affect the validity of the
remaining portions thereof.

SECTION IV ESTABLISHING EFFECTIVE DATE
This ordinance shall take effect on November 1, 2006.
SECTION V PROVIDING FO PENALTIES
Any violation of any provision of this ordinance,or any
provisions adopted herein,shall be punishable as a Class One
Misdemeanor consistent with Apache Junction City Code, Chapter 1
GENERAL,Article 1-8 PENALTY.

C.Plan Review, Pool/Spas/Hot Tubs, Wrecking Buildings,
Manufactured Home and Accessory Building Permit Fees
Plan Review Fees. Plan review fee shall be 65% (percent) of the
permit fees as shown in Building Valuation Data. In no case
shall plan review fee be less than $25.00.
Permit Fee Schedule. Unless otherwise indicated, the following
fees will be applicable to residential and non-residential
projects:
