AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE
CITY OF APACHE JUNCTION, ARIZONA, AMENDING THE
APACHE JUNCTION, ARIZONA, ZONING ORDINANCE,BY
AMENDING THE ZONING DISTRICT MAP, CITY OF APACHE
JUNCTION, ARIZONA,CHANGING THE ZONING DISTRICT
CLASSIFICATION IN REZONING CASE PZ-07-06, A
REQUEST BY BARBARA SAURIN, ON BEHALF OF DONALD
HILL, FROM CB -1 ("LOCAL BUSINESS ZONE") TO CR-3/PD
("SINGLE-FAMILY RESIDENCE ZONE 7,500 SQUARE FOOT
LOT BY PLANNED DEVELOPMENT"); REPEALING ANY CON-
FLICTING PROVISIONS; AND PROVIDING FOR SEVERABILITY_
WHEREAS, On July 25, 2006, the Apache Junction Planning
and Zoning Commission voted unanimously 7 to 0 to recommend
approval of rezoning request Case PZ-07-06; and
WHEREAS,the proposed rezoning,subject to the
conditions set forth herein, enables the use and integration
of contemporary land planning principles in such a manner to
promote its most appropriate use and ensure residential land
use densities that are in compliance with the 1999 City of
Apache Junction General Plan.
NOW,THEREFORE,BE IT ORDAINED BY THE MAYOR AND CITY
COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA THAT:
SECTION I.IN GENERAL
The zoning district classification on the Zoning District
Map, City of Apache Junction, Arizona for the parcels of
land legally described as:
Lot 54, Palm Springs Unit 5, according to the
Plat of record in the office of the County
Recorder of Pinal County, Arizona, in Book 13
of Maps, Page 55, also known as Pinal County
Assessor Parcel Number 102-23-054,
be and hereby is amended from CB -1 (Local Business Zone) to
CR-3/PD (Single -Family Residence Zone, 7,500 square foot
lots by Planned Development), subject to the following
conditions:
1) Lot setbacks shall be twenty feet (20') front yard,
twenty feet (20') rear yard, no side yard shall be
less than five feet (5'), and the total of both

side yards shall be not less than fourteen feet
(14')(with alley access, even if not being used).
2) Lot to be furnished with a front yard landscape
package with plant quantities to include: two (2)
twenty four inch (24") box trees, five (5) shrubs,
and fifty (50) square feet of vegetative ground
cover.
3) Unit to be painted with Southwestern color tones
as defined by the City of Apache Junction Design
Guidelines.Must be different from adjacent
dwelling.
4) Include a ground -mounted heating, ventilation and
air conditioning ("1-RWr') unit and place it behind
the main building.
SECTION II.REPEALING ANY CONFLICTING PROVISIONS
All ordinances and parts of ordinances in conflict with the
provisions of this ordinance are hereby repealed.
SECTION III.PROVIDING FOR SEVERABILITY
If any section, sub -section, sentence, phrase, clause or
portion of this ordinance, or any part of the code adopted
herein by reference, is for any reason held to be invalid or
unconstitutional by the decision of any court of competent
jurisdiction, such decision shall not affect the validity of
the remaining portions thereof.
