HomeMy WebLinkAboutORD1278ORDINANCE NO.1278 AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA, AMENDING APACHE JUNCTION CITY CODE, VOLUME I, CHAPTER 4 FEES,ARTICLE 4-4, DEVELOPMENT SERVICES DEPARTMENT FEES,BY CORRECTING FEE SCHEDULE A.BUILDING PERMIT FEES,AND FEE SCHEDULE C. PLAN REVIEW, POOLS, SPAS, HOT TUBS, WRECKING BUILDINGS, MANUFACTURED HOMES AND ACCESSORY PERMIT FEES;REPEALING ANY CONFLICTING PROVISIONS; PROVIDING FOR SEVERABILITY; ESTABLISHING AN EFFECTIVE DATE; PROVIDING FOR PENALTIES; AND DECLARING AN EMERGENCY. WHEREAS, on September 5, 2006, the Apache Junction Mayor and City Council passed Ordinance No. 1274, which amended the Apache Junction City Code, Volume I, by repealing Chapter 4 Fees,Article 4-4 Planning, Zoning, Review and Subdivision Fees and Article 4-5,Special Sign Permit Fees,and adopted by reference a new Chapter 4 Fees, Article 4-4,Development Services Department Fees;and WHEREAS, on September 5, 2006 the Apache Junction Mayor and City Council passed Resolution No. 06-38 which declared as a public record that certain document filed with the City Clerk and entitled "Apache Junction City Code, Chapter 4 Fees,Article 4-4,Development Services Department Fees"; and WHEREAS, unbeknownst to the Mayor and City Council at the time of passage,fee schedule A.Building Permit Fees and fee schedule C.Plan Review, Pools, Spas, Hot Tubs, Wrecking Buildings, Manufactured Homes Accessory Permit Fees contained several incorrect numerical figures; and WHEREAS, it is the intent of the Mayor and City Council to correct these schedules by readoption; and WHEREAS,if this Ordinance is passed without an emergency clause, the corrected fee schedules will go into effect after the incorrect schedules have been in effect; and WHEREAS, it is necessary to declare an emergency to establish November 1, 2006 as the effective date so that passage of these revisions coincide with the effective date of the remaining Development Services Department fee schedules. ORDINANCE NO 1278 PAGE 1 OF 5 NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA, AS FOLLOWS: SECTION I IN GENERAL 1.Apache Junction City Code, Volume I, Chapter 4 Fees,Article 4-4 Development Services Department Fees,A.Building Permit Fees,shall be amended in its entirety as follows: Article 4-4 A.Building Permit Fees TOTAL VALUATION $1.00 TO $500.00 $29.50 $501.00 TO $2,000.00 $29.50 for the first $500.00 plus $3.83 for each additional $100.00 or fraction thereof, to and including $2,000.00. $2,001.00 to $25,000.00 $87.00 for the first $2,000.00 plus $17.58 for each additional $1,000.00 or fraction thereof, to and including $25,000.00. $25,001.00 to $50,000.00 $490.40 for the first $25,000.00 plus $12.65 for each additional $1,000.00 or fraction thereof, to and including $50,000.00. $50,001.00 to $100,000.00 $808.62 for the first $50,000.00 plus $8.79 for each additional $1,000.00 or fraction thereof, to and -including $100,000.00. $100,001.00 to $500,000.00 $1,247.00 for the first $100,000.00 plus $7.00 for each additional $1,000.00 or fraction thereof, to and including $500,000.00. $500,001.00 to $4,060.00 for the first $1,000,000.00 $500,000.00 plus $5.96 for each additional $1,000.00 or fraction thereof, to and including $1,000,000.00. $1,000,001.00 and up $7,315.00 for the first $1,000,000.00 plus $4.11 for each $1,000.00 or fraction thereof. ORDINANCE NO. 1278 PAGE 2 OF 5 2.Apache Junction City Code, Volume I, Chapter 4 Fees, Article 4-4 Development Services Department Fees, C.Plan Review, Pools/Spas/Hot Tubs, Wrecking Buildings, Manufactured Home and Accessory Building Permit Fees,shall be amended in its entirety as follows: C.Plan Review, Pools/Spas/Hot Tubs, Wrecking Buildings, Manufactured Home and Accessory Building Permit Fees: Plan Review Fees.Plan review fee shall be sixty-five percent (65%) of the permit fees as shown in Building Valuation Data. In no case shall plan review fee be less than $25.00. Permit Fee Schedule.Unless otherwise indicated, the following fees will be applicable to residential and non- residential projects: Swimming Pools In -Ground .................................................$250.00 Spas/Hot Tubs "When standard pool/spa/hot tub plans are not on file with the Building Official, a $100.00 plan review fee will also be charged. Wrecking Buildings Residential accessory building or garage ..................$25.00 Single-family residence ...................................$100.00 Structures other than residential single-family ..........$100.00 Manufactured Home Permit Fee ................................................$200.00 Plan review fee ............................................$50.00 Factory Built Building Residential ...............................................$400.00 Commercial ...................$2.00 per lineal foot per story Temporary sales trailer Building permit ...........................................$200.00 Plan review ................................................$50.00 Generators for Temporary Trailers(Each) ...................$25.00 (Note: These fees do not include electrical or development fees) ORDINANCE NO. 1278 PAGE 3 OF 5 SECTION II REPEALING ANY CONFLICTING PROVISIONS All ordinances and parts of ordinances in conflict with the provisions of this ordinance or any part of the codes adopted herein by reference are hereby repealed. SECTION III PROVIDING FOR SEVERABILITY If any section,subsection,sentence,phrase,clause or portion of this ordinance or any part of the codes adopted herein by reference is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions thereof. SECTION IV ESTABLISHING EFFECTIVE DATE This ordinance shall take effect on November 1, 2006. SECTION V PROVIDING FOR PENALTIES Any violation of any provision of this ordinance,or any provisions adopted herein,shall be punishable as a Class One Misdemeanor consistent with Apache Junction City Code, Chapter 1 GENERAL,Article 1-8 PENALTY. SECTION VI DECLARING AN EMERGENCY The immediate operation of the provision of this ordinance is necessary for the immediate preservation of the public peace,health or safety,and that an emergency is hereby declared to exist; and this ordinance shall be in full force and effect from and after its passage, adoption and approval by mayor and city council of the City of Apache Junction, except as noted in Section IV above.
