AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE
CITY OF APACHE JUNCTION, ARIZONA, AMENDING THE
APACHE JUNCTION, ARIZONA, ZONING ORDINANCE,BY
AMENDING THE ZONING DISTRICT MAP, CITY OF APACHE
JUNCTION, ARIZONA,CHANGING THE ZONING DISTRICT
CLASSIFICATION IN REZONING CASE PZ-12-06 FROM
TRAILER HOMESITE ("TH") TO CONVENTIONAL SINGLE
FAMILY HOMES BY PLANNED DEVELOPMENT ("CR-2/PD");
REPEALING ANY CONFLICTING PROVISIONS; AND
PROVIDING FOR SEVERABILITY.
WHEREAS, on September 26, 2006, the Apache Junction
Planning and Zoning Commission voted to recommend approval
of the rezoning request in Case PZ-12-06 by a vote of 7 to
0, subject to conditions of approval; and
WHEREAS, the proposed rezoning conforms to all of the
applicable criteria as specified in the City of Apache
Junction Zoning Ordinance,Article 19 Planned Development
Zoning District,Section 19.0109 General Criteria,and is
in compliance with the General Plan, integrates with the
surrounding neighborhood, adequately accommodates traffic,
will have adequate.public facilities, and the design and
uses will result in enhancement to the social, built, and
natural environment of the City.
NOW, THEREFORE, be it ordained by the Mayor and City
Council of the City of Apache Junction, Arizona, as
follows:
SECTION I:IN GENERAL
The zoning district classification on the Zoning District
Map, City of Apache Junction, Arizona,for the parcel of
land legally described as:
The North 126 Feet of the South 282 feet of the
West half of the Southeast quarter of the South
West quarter of the Northwest quarter of Section
30, Township 1 North, Range 8 East, of the Gila
and Salt River Base and Meridian, Pinal County,
Arizona,(known as Pinal County Assessors Parcel
Number 102-34-056A), approximately .86 gross acres;

be and hereby is amended from TH to CR-2/PD subject to the
following conditions of approval:
1) Street improvements, such as extension of pavement
and the provision of sidewalk, curb, gutter, and
streetlights, normally required for CR-2 zoned,
11,000 net square foot minimum lots, shall not be
required as part of this planned development
rezoning.
2) The future three lots shall be created through the
City's Land Split process.
3) The proposed houses shall be a minimum of 1,400
livable square feet in size, shall include
southwestern architectural features as illustrated
in the City's Design Guidelines, shall offer ground
mounted air conditioning units, and architectural
treatments on all four sides of the building so as
to preclude flat or blank facades, including pop-
outs, roofline, and color variations to add visual
interest.
4) Front -yard xeriScape'landsc-ape packages shall be
provided with the development of the lots, to
include a minimum of three 24 inch box trees, four
5 gallon shrubs and groundcovers and decomposed
granite as specified in the City of Apache Junction
Landscaping and Screening Requirements.
5) All applicable permits shall be applied for and
plans shall be designed to current City codes prior
to any building removal, lot grading, or
construction on the lots.Inclusively, all
applicable development fees shall be paid at the
time of permits issuance.
6) A 28' wide by 226' long private access way shall be
created along the north property line and improved
to an alley standard as defined by the City
Engineer.
7) A recordable document providing perpetual right of

ingress and egress for access and utility purposes,
for the benefit of all three parcels, shall be
executed by the property owners subsequent to the
approval of the Land Split Map described in
Condition #2 above.
8) The recordable document described in Condition #7
shall require that all future maintenance costs be
split evenly between all three property owners.
9)All three resultant lots of the proposed Land Split
shall be addressed on South Cedar Drive. Appropriate
address signage shall be provided at the entrance of
the private access way for all three lots.
10) A one foot wide vehicular non -access easement shall
be recorded along the property's west boundary
excluding the 28' wide access easement.
SECTION II:REPEALING ANY CONFLICTING PROVISIONS
All ordinances and parts of ordinances in conflict with the
provisions of this ordinance are hereby repealed.
SECTION III:PROVIDING FOR SEVERABILITY
If any section, sub -section, sentence, phrase, clause, or
portion of this ordinance, or any part of the code adopted
herein by reference, is for any reason held to be invalid
or unconstitutional by the decision of any court of
competent jurisdiction, such decision shall not affect the
validity of the remaining portions thereof.

CITY OF APACHE JUNCTION, ARIZONA, THIS 17TH DAY OF
