HomeMy WebLinkAboutORD1281ORDINANCE NO. 1281 AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA, AMENDING THE APACHE JUNCTION, ARIZONA, ZONING ORDINANCE,BY AMENDING THE ZONING DISTRICT MAP, CITY OF APACHE JUNCTION, ARIZONA,CHANGING THE ZONING DISTRICT CLASSIFICATION IN REZONING CASE PZ-11-06, FROM GENERAL RURAL ("GR") TO CONVENTIONAL OR MANUFACTURED SINGLE-FAMILY HOMES ("CR-1/MH"); REPEALING ANY CONFLICTING PROVISIONS; AND PROVIDING FOR SEVERABILITY. WHEREAS, on September 26, 2006, the Apache Junction Planning and Zoning Commission voted to recommend approval of the rezoning request Case PZ-11-06 by a vote of 7 to 0, subject to the conditions of approval listed in this ordinance; and WHEREAS, the City Council hereby determines that the proposed rezoning conforms to all of the applicable criteria as specified in the City of Apache Junction Zoning Ordinance,Article 15 Residential Zoning Districts,Section 15.0200 CR-I AND CR•=1 (MH) Single -Family Residence Zones, and is in compliance with the General Plan, integrates with the surrounding neighborhood, adequately accommodates traffic, will have adequate public facilities, and the design and uses should result in the enhancement of the social, built, and natural environment in the City. NOW, THEREFORE, be it ordained by the Mayor and City Council of the City of Apache Junction, Arizona, as follows: SECTION I:IN GENERAL The zoning district classification on the Zoning District Map, City of Apache Junction, Arizona,for the parcel of land legally described as: Lot 7, Block 3, Apache Addition Acres, according to the plat of record in the office of the County ORDINANCE NO. 1281 PAGE 1 OF 4 Recorder of Pinal County, Arizona, Book 5 of Maps, Page 32 (also known as Pinal County Assessor's Parcel Number 101-15-049B), approximately 43,500 square feet, be and hereby is amended from GR to CR-1/MH subject to the following conditions of approval: 1) The future two lots shall be created through the City's Land Split process. 2) A 28 foot wide by 168 foot long (28'X168') private access way shall be created along the south property line and improved to an alley standard as defined by the City Engineer. 3) Subsequent to a land split, the development of the west lot shall include a manufactured home that has previously not been lived in, double wide, ground set, with an architectural character fitting the southwest. 4) The existing storage shed shall either be removed or all applicable building permits 'must be applied for and approved for this accessory structure before the development of the west lot can begin. 5) Front yard xeriscape landscape packages shall be provided with the development of the lots, to include a minimum of five 24 -inch box trees, eight 5 -gallon shrubs and groundcovers and decomposed granite as specified in the City of Apache Junction Landscaping and Screening Requirements. 6) All applicable permits shall be applied for and plans shall be designed to current City codes prior to any further lot grading or construction on the lots. Inclusively, all applicable development fees shall be paid at the time of permits issuance. 7) A recordable document providing perpetual right of ingress and egress for access and utility purposes, for the benefit of both parcels, shall be executed ORDINANCE NO. 1281 PAGE 2 OF 4 by the property owners subsequent to the approval of the Land Split Map described in Condition #1 above. 8) The recordable document described in Condition #7 shall require that all future maintenance costs be split evenly between the owners of both properties. 9) Both resultant lots of the proposed land split shall be addressed on North Gold Drive. Appropriate address signage shall be provided at the entrance of the private access way for both lots. 10) A one foot wide vehicular non -access easement shall be recorded along the property's west boundary, excluding the 28' wide accesS easement. SECTION II:REPEALING ANY CONFLICTING PROVISIONS All ordinances and parts of ordinances in conflict with the provisions of this ordinance are hereby repealed. SECTION III:PROVIDING FOR SEVERABILITY If any section, sub -section, sentence, phrase, clause, or portion of this ordinance, or any part of the code adopted herein by reference, is for any reason held to be invalid or unconstitutional by the, decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions thereof.
