AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF
THE CITY OF APACHE JUNCTION,ARIZONA,AMENDING
THE APACHE JUNCTION,ARIZONA,ZONING ORDINANCE,
BY AMENDING THE ZONING DISTRICT MAP,CITY OF
APACHE JUNCTION,ARIZONA,CHANGING- THE ZON;
DISTRICT CLASSIFICATION IN REZONING CASE PZ 3-
06, FROM TRAILER HOMESITE BY PLANNED DEVELe'MENT
—TH/PD"TO GENERAL COMMERCIAL BY *LANNED
DEVELOPMENT —C-3/PD"; REPEALING ANY C•IFLICTING
PROVISIONS; AND PROVIDING FOR SEVERAB ITY.
WHEREAS,effective May 6,2005,he City of Apache
Junction and the property owners ç.iitered into a Pre-
annexation and Economic DevelopmenX Agreement for the
property described herein; and
. WHEREAS,on June 21,2005,Ahe Apache Junction City
Council unanimously voted to approve the request for
rezoning Case PZ-2-05,to c ange the zoning district
classification from TH to TH/P ; and
WHEREAS, on October 2,006, the property owners filed
a rezoning request to 1facilitate Phase I of their
comprehensive developmen plan which included the
construction of a motel oyI a portion of the property; and
WHEREAS,on Octo er 24,2006,the Apache Junction
Planning.and Zoning Cçvfnmission voted to recommend denial of
this rezoning request/in Case PZ-13-06 by a vote of 4 to 2,
subject to the co ditions of approval listed in this
ordinance; and
.WHEREAS,thr City Council hereby determines that the
proposed rezoni • conforms to all of the applicable criteria
as specified in the City of Apache Junction Zoning
Ordinance,Ar.icle 19 Planned Development Zoning District,
Section 19.0 09 General Criteria,and is in compliance with
the Gener-Plan,integrates with the surrounding
neighborhood,adequately accommodates traffic,will have
adequate •ublic facilities,and the design and uses should
result enhancement to the social,built,and natural
enviro ,ent in the City.
OW,THEREFORE,be it ordained by the Mayor and City
Couqeil of the City of Apache Junction, Arizona, as follows:
TION I: IN GENERAL

The zoning district classification on the Zoning District
Map, City of Apache Junction, Arizona,for the parcel of
land legally described as:
The East 252 feet of the West 621.49 feet of
the South half of the North half of the
Southwest quarter of the Northwest quarter of
Section 34,Township 1 North,Range 8 East of
the Gila and Salt River Base and Meridian,
Pinal County, Arizona,
A 2.08 acre section of the parcel known as
Pinal County Assessors Parcel Number 103-22-
004A;
Is hereby amended from TH/PD to C-3/PD, subject to the
following conditions of approval:
1) Street improvements, such as extension of pavement
and the provision of sidewalk, curb, gutter, and
streetlights, normally required as part of a
subdivision shall be required as part of this
planned development rezoning.
2) The architectural character of the building shall be
of a southwest style in accordance with the City's
Design Guidelines, to include at a minimum; stucco
finish with stone façade enhancements, wrought iron
window treatments, architectural treatments to all 4
sides including pop -outs as to preclude flat or
blank façades east and west porticos, and a Spanish
mission red -tile roof shall be provided.
3) Building height shall not exceed 39 feet 10 34 inches
at the apex of the roof.
4) Sign height shall not exceed thirty feet (30').
5) Sign animation shall be allowed.The frequency of
messages shall be limited to one screen change every
15 seconds and continuous animation or scrolling
messages shall be prohibited.
6) Landscaping shall be installed in accordance with
the Landscaping and Screening Requirements,
including, but not limited to, landscaping the
entire 25 foot front setback area and 5 foot
landscape strip to the east, exclusive of driveways
and entrances.A 6 foot screening wall or wrought
iron fence shall be required along the west property
line. An 8 foot fence on the east property line of

the lot shall not be required. Along the front
property line either a 3 foot pony wall or berm
shall be required to screen the parking lot from the
street.
7) All applicable permits shall be applied for and
plans shall be designed to current City codes prior
to any lot grading or construction on the lots. All
applicable development fees shall be paid at the
time of permits issuance.
8) The next land split shall require a subdivision
process.
9) Trellises with climbing vegetation shall be provided
on the north and south faces of the building in
order to visually break up the building mass.
10) The freeway sign shall be reconfigured to fit within
the support poles.
11) The hotel shall become a member of the Police
Departments Crime Free Multi -Housing program.The
landscape and parking areas must establish Crime
Prevention Through Environmental Design (CPTED)
strategies.
SECTION II: REPEALING ANY CONFLICTING PROVISIONS
All ordinances and parts of ordinances in conflict with the
provisions of this ordinance are hereby' repealed.
SECTION III: PROVIDING FOR SEVERABILITY
If any section, sub -section, sentence, phrase, clause, or
portion of this ordinance, or any part of the code adopted
herein by reference, is for any reason held to be invalid or
unconstitutional by the decision of any court of competent
jurisdiction, such decision shall not affect the validity of
the remaining portions thereof.
