AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF
APACHE JUNCTION, ARIZONA, ESTABLISHING THE SPEED LIMIT
FROM 40 MPH TO 25 MPH BETWEEN 7 AM TO 4 PM ON SCHOOL DAYS
ON IRONWOOD DRIVE BETWEEN 4 TH AVENUE AND APPROXIMATELY
300 FEET SOUTH OF BROADWAY AVENUE AND ON BROADWAY AVENUE
BETWEEN PALO VERDE DRIVE AND GOLD DRIVE AND AUTHORIZING
THE INSTALLATION OF SCHOOL CROSSING SIGNS, CROSSWALKS,
AND ENFORCEMENT OF SIGNAGE AT THESE LOCATIONS; REPEALING
ANY CONFLICTING PROVISIONS;AND PROVIDING FOR
SEVERABILITY.
WHEREAS, due to the failure of the November 2007 Maintenance
and Operation Budget Override Election, the Apache Junction Unified
School District recently began requiring school children who live
within one (1) mile of a school to walk to school rather than ride
a school bus; and
WHEREAS,within the vicinity south of Broadway Avenue on
Ironwood Drive, the new District rule now causes many school age
children to cross Ironwood Drive and Broadway Avenue in order to
attend Superstition Mountain Elementary School; and
WHEREAS, the existing speed limits on Ironwood Drive and on
Broadway Avenue during school hours of 7:00 a.m. to 4:00 p.m. are a
safety concern; and
WHEREAS,the speed limits: on _.0 -iese, roadways need to be
modified during school hours to enhance the safety of school
children who are no longer provided District transportation; and
WHEREAS, the City also desires to protect school children by
providing related school crossings and signage; and
WHEREAS, pursuant to Arizona Revised Statutes ("A.R.S.") § 9-
276, it is in the public,interest to ensure safe, effective and
efficient traffic flow along public rights -of -way within the City
of Apache Junction, Arizona.The Mayor and City Council find that
speed limits are necessary to further this goal.Pursuant to
Apache Junction City Code § 12-2-4i, the City may establish and/or
change speed limits as deemed necessary foi the public safety; and
WHEREAS,in accordance with A.R.S.§28-703(E),a local
authority may also alter the maximum speed limit on its streets but

may not make More than six alterations per mile, in increments of
ten miles per hour for each alteration.
NOW,THEREFORE,BE IT ORDAINED THAT BY THE MAYOR AND CITY
"COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA, as follows:
SECTION I IN GENERAL
1.The speed limit on Ironwood Drive between 4th Avenue to
approximately 300 feet south of Broadway Avenue is
changed from 40 mph to 25 mph from 7:00 a.m. to 4:00 p.m.
on School Days and school crossings/signage shall be
installed and .such changes are reflected on the attached
map.
2.The speed limit on Broadway Avenue between Palo Verde
Drive to Gold Drive is changed from 40 mph to 25 mph from
7:00 a.m.to 4:00 p.m.on School Days and school
crossings/signage shall be installed and such changes are
reflected on the attached map.
3.The Direator of Public Works and the Director of Public
Safety are hereby empowered and directed to initiate
appropriate action to install speed limit signs and
enforce the Speed limits in the above -noted areas as
reflected on the attached Map.
SECTION II REPEALING ANY CONFLICTING PROVISIONS
All ordinances and parts of ordinances in conflict with the
provisions of this ordinance,or any part of the code adopted
herein by reference, are hereby repealed.
SECTION III PROVIDING FOR SEVERABILITY
•
If any section, subsection, sentence, phrase,, clause or portion of
this ordinance,or any part of the code adopted herein by
reference, is for any reason held to be invalid or unconstitutional
by the decision of any court of competent jurisdiction,such
decision shall not affect the validity of the remaining portions
thereof.
