AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE
CITY OF APACHE JUNCTION,ARIZONA,AMENDING THE
APACHE JUNCTION CITY CODE VOLUME II,LAND
DEVELOPMENT CODE,CHAPTER 1,ZONING ORDINANCE,
BY AMENDING THE ZONING DISTRICT MAP,CITY OF
APACHE JUNCTION,ARIZONA,AMENDING THE PLANNED
DEVELOPMENT ZONING DISTRICT CLASSIFICATION IN
REZONING CASE PZ-6-07,AMENDING ORDINANCE 1134;
REPEALING ANY CONFLICTING PROVISIONS;AND
PROVIDING FOR SEVERABILITY.
WHEREAS,on June '26,2007,the Apache Junction
Planning and Zoning Commission voted to recommend approval
of the planned development amendment request,Case PZ-6-07
by a vote of 6 to 0,subject to the conditions of approval
listed in this ordinance; and
WHEREAS,the City Council hereby determines that the
proposed planned development amendment conforms to all of
the applicable criteria as specified in the Apache Junction
City Code,Volume II,Land Development Code,Chapter 1,
Zoning Ordinance Article 19 Planned Development Zoning
District,Section 1:9.0109 General Criteria,and is in
compliance with the Apache Junction General Plan,
integrates with the surrounding neighborhood,will have
adequate public facilities,and the, ,design -and uses should
result in enhancement to the: social;built,and natural
environment in the City.
NOW,THEREFORE,BE IT ORDAINED BY THE MAYOR AND CITY
COUNCIL OF THE CITY 'OF APACHE JUNCTION,ARIZONA,AS
FOLLOWS:
SECTION I: IN GENERAL
The zoning district classification -on the Zoning District
Map,City of Apache Junction,Arizona,for the parcel of
land legally described
Lots 2,3,5 &6 of the Idaho &Superstition
Commercial Subdivision, According to the Plat of

Record in the office of the Recorder of Final
County, Arizona, Recorded in Cabinet .B Slide 116,
'a subdivision of a portion of the South Half of
the North Half of the Southwest Quarter of the
Northwest Quarter of Section 33,Township 1
North,Range 8 'East of the Gila and Salt River
Base and Meridian, Final County, Arizona.
EXCEPT the West 198 feet; and
Also known as Final County Assessors Parcel
Number 102-21-039A,102-21-040,102-21-041,102-
21-043 and 102-21-044;
be and hereby is amended,subject to the following
conditions:
1. All other ordinances relating to this property are in
full force and effect except where conditioned herein.
2. The uses permitted by Ordinance 1134 Condition #2 be
amended and any future development shall fall under
the list of permitted uses.set forth in Attachment A.
3.. Any future development of this site shall be designed
in accordance with the 'City's Design Guidelines and
Landscaping and Screening ReuirementS ii a. manner
complementary to the surrounding area and.shali be
subject to final approval by the city Council during
final Planned Development plan approval.
4. Lots 102-21-039A and 102-21-040 shall be. combined into
one lot.
SECTION II: REPEALING ANY CONFLICTING PROVISIONS
All ordinances and parts of ordinances dn conflict with the
provisions of this ordinance are hereby repealed.
SECTION III: PROVIDING FOR SEVERABILITY
If any section,sub -section,sentence,phrase,clause,or
portion of this ordinance, or any part of the code adopted

herein by reference,is for any reason held to be invalid
or unconstitutional by the decision of any court of
competent jurisdiction,such decision shall not affect the
validity of the remaining portions thereof.

CITY OF APACHE JUNCTION,ARIZONA,THIS 7TH DAY OF
AUGUST , 2007.
