AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF
APACHE JUNCTION, ARIZONA, AMENDING THE APACHE JUNCTION,
ARIZONA, ZONING ORDINANCE,BY AMENDING THE ZONING DISTRICT
MAP, CITY OF APACHE JUNCTION, ARIZONA,BY APPROVING A
PLANNED DEVELOPMENT PLAN FOR A LIGHT INDUSTRY AND WAREHOUSE
ZONE BY PLANNED DEVELOPMENT (CI-1/PD)-ZONED PROPERTY,IN
CASE PZ-2-08, A PLANNED DEVELOPMENT AMENDMENT REQUEST BY
EMPIRE SOUTHWEST, LLC, REPRESENTED BY GRANT TAYLOR;
REPEALING ANY CONFLICTING PROVISIONS; AND PROVIDING FOR
SEVERABILITY.
WHEREAS, on July 18, 1989, the City Council approved Ord-
inance No. 680, which rezoned the subject property from General
Rural (GR) to Light Industry and Warehouse Zone by Planned Dev-
elopment (CI-1/PD), for the purpose of creating opportunities
for commercial and light industrial businesses, but with no
specific development plan for the property; and
WHEREAS, on April 22, 2008, the Apache Junction Planning
and Zoning Commission voted unanimously (4 to 0) to recommend
approval of Planned Development Amendment case PZ-2-08, which
recommends a specific Planned Development Plan for a heavy
equipment sales, rentals, service and repair facility to be
operated by Empire Southwest, LLC; and
WHEREAS, the City Council hereby determines that the
proposed Planned Development Plan conforms to all of the general
criteria as specified in Section 17.0100 CI -1 Light Industry and
Warehouse Zone and Section 19.0109 General Criteria of the
Planned Development Zoning District regulations of the City of
Apache Junction Zoning Ordinance,including compliance with the
General Plan, integration with the surrounding neighborhood,
adequate traffic accommodation, adequate public facilities,
extension of infra -structure, and that the design and uses
should result in enhancements to the social, built, and natural
environments in the City.
NOW THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL
OF APACHE JUNCTION, ARIZONA, AS FOLLOWS:

SECTION I IN GENERAL
The Planned Development Plan for the CI-1/PD-zoned property, as
shown on the Zoning District Map, City of Apache Junction,
Arizona, for the parcel of land legally described as:
The Northwest quarter of the Northeast quarter of the
Southwest quarter of Section 33, EXCEPT for the
Southwest quarter thereof; and the Northeast quarter
of the Northeast quarter of the Southwest quarter of
Section 33, Township One North, Range 8 East of the
Gila and Salt River Base and Meridian; EXCEPT for any
portion thereof lying north of the south right-of-way
line of US60; and EXCEPT for any portion thereof lying
within the platted boundaries of Baseline Industrial
Park Subdivision, recorded in Cabinet C, Slide 060,
Pinal County Recorder's Office.
be and hereby is approved, subject to the following conditions
of approval:
1) The property owners shall dedicate and impi.ove to the City
Engineer's standards, any necessary adjacent rights -of -way,
including S. Winchester Road (with cul-de-sac) and E. 34'
Avenue; and shall provide for a controlled access point
(exit only) at the southwest corner of the property.
2) All on -site driving and parking areas shall be surfaced
with concrete or asphalt.Equipment yards shall be
surfaced with two-inch (2") rocks, six inches (6") deep
3) Any existing adjacent utilities (12kv or smaller) shall be
relocated underground, and any existing or proposed on -site
utilities shall also be located underground.
4) Developer shall provide adequate on -site retention and
accommodate off -site drainage according to City drainage
policies.
5) All areas which could generate chemical or fuel spills
shall be contained and provided with a separate retention
basin and Envibro System drywell or equivalent.

6) Developer shall provide any necessary fire hydrants and
install fire prevention devices and Knox emergency access
components as required by the Fire District.
7) Building elevations shall incorporate various texture block
types with 16" -wide darker brick separation bands, closer
in character with the concepts of the city's Design
Guidelines.This concept shall be carried through to all
buildings on site.
8) Combination wrought iron and split faced block masonry
fences shall be provided, particularly along the property's
west and north frontages.
9)Additional corporate values signage elements and other
attached 6' x 24' building mounted signs shall be permitted
as illustrated on the submitted concept plans.The
detached monument sign on S. Winchester Road shall comply
with the city's Sign Code.The detached monument sign
along U.S.60 Freeway shall comply with the city's Sign Code
for freeway oriented signs, unless a Conditional Use Permit
is separately approved for a taller or larger sign.
10) Landscaping shall comply with the city's Landscaping and
Screening Requirements, except that 50% of the required
trees along the north, west and south frontages shall be
24" box in size and all required shrubs shall be 5 -gallon
in size.
11) The two permitted detached signs shall incorporate split-
faced block with the darker 16" trim block on the bases of
the monuments.The freeway sign shall be permitted to be
25 feet high above adjacent freeway grade, as included in
the Planned Development plan request.The applicants shall
work with Staff on the final concept design for both signs
to achieve a final concept design.
12) The customers work with our Staff to get as much
improvement on the signs as possible; the stone going as
high as possible.

SECTION II REPEALING ANY CONFLICTING PROVISIONS:
All ordinances and parts of ordinances in conflict with the
provisions of this ordinance are hereby repealed.
SECTION III PROVIDING FOR SEVERABILITY:
If any section, sub -section, sentence, phrase, clause or portion
of this ordinance, or any part of the code adopted herein by
reference, is for any reason held to be invalid or unconsti-
tutional by the decision of any court of competent jurisdiction,
such decision shall not affect the validity of the remaining
portions thereof.
