QUIKTRIP CORPORATION,REPRESENTED BY MATT MILLER, T AMEND THE EXISTING PLANNED DEVELOPMENT OVERLAY ZONING DIS RICT OF C-3/PD (GENERAL COMMERICAL BY PLANNED DEVELOPMENT RDINANCE #1062)TO ALLOW THE DEVELOPMENT OF A FUELING j TATION AND CONVENIENCE STORE;R4eEALING ANY CONFLICTINV PROVISIONS; AND PROVIDING FOR SEVE4BILITY. NOW THEREFORE, BE IT ADAINED BY THE MAYOR AND CITY COUNCIL OF APACHE JUNCTION, ARIZOOA, AS FOLLOWS: SECTION I IN GENERAL The zoning district lassification on the Zoning District Map, City of Apache Jun tion, Arizona, for the parcel of land legally described as: Beginning t southeast corner of section 31 W-50 to point of begin ing W-377.81 N-579.30 E-377.80 S-579.30 to point of beg' ning except S-241 thereof except E-35 thereof as described in SPEC WD 2000-007827 as conveyed to the City of ApacjKe Junction .27 AC 1N -8E be and /11 ereby is amended to C-3/PD, subject to the following condi ions of approval: Ordinance No. 1322 Page 1 of 4 1)Vehicular access to the site to and from Baseline Avenue shall be implemented into the development as approved by the City Engineer. 2)A Geo-Technical Report shall be submitted to the City Development Services Department prior to the issuance of a building permit. 3)An Environmental Report shall be submitted to the C Development Services Department prior to the issu building permit. 4)All lighting under the canopy shall be flusVmounted. 5)All shrubs shall be 5 gallon in size, 50X of the requested trees shall be 24 -inch box trees, and e other 5(A shall be 36 -inch box trees to be disbursed venly all around the site. 6)All 24 -inch box trees shall hay inches and all 36 -inch box tre caliper of 2.5 inches. a minimum caliper of 1.5 s shall have, -.,a minimum 7)The trees in the front pl terscs181 ygocated at least efour feet away from each /end of t e er."order to prevent any future damage to t4 pa.).c ent a c o allow the trees to grow. 8)The trees in the frØit of subject site shall be located at least three fee back 46m the proposed wall in order to prevent any futur,damage o the wall. 9)The proposed f nt planters shall be widened to 14 feet by 20 feet and t e trees shall be planted in order for shade to be provid d for the front of the building. 10)The archit cture of the front of the building shall be improved y including an expanded covered pedestrian element ("awning") covering the front walkway and entry provi ng shade and having a southwestern design in order to b consistent with the City's Commercial Design Guide lines. Ordinance No. 1322 Page 2 of 4 11)Any driveways off of South Ironwood Drive shall be limited to right-in/right-out only turning movements by means of a raised traffic control curb ("pork -chop"). 12)Development of the site shall be in accordance with the approved amended planned development plan pursuant t Option #1 or Option #2 discussed in Case File PZ- -08, copies of which are attached hereto as exhibit 9-( Any other or future uses shall require a new planned c3,eelopment amendment submittal. SECTION II REPEALING ANY CONFLICTING PROVISIONS: ///All ordinances and parts of ordinances/1n conflict with the provisions of this ordinance are herby repealed. SECTION III PROVIDING FOR SEVERABILITY: If any section, sub-section,/Sentence, phrase, clause or portion of this ordinance, or any Fdrt of the code adopted herein by reference, is for any reasbn held to be invalid or unconstitutional by theAfecision of any court of competent jurisdiction, such dey:sion shall not affect the validity of the remaining portions thereof.
