HomeMy WebLinkAboutORD1382ORDINANCE NO. 1382 AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA, REPEALING ORDINANCE NO. 885 IN ITS ENTIRETY; REPEALING ANY CONFLICTING PROVISIONS; PROVIDING FOR SEVERABILITY; AND DECLARING AN EMERGENCY. WHEREAS,Ordinance No.885 was enacted by the City Council a s a stand-alone ordinance on February 15,1994,which established a rotation list process whereby tow businesses had to meet certain equipment,personnel,facility and other requirements in order to be called by the police department to perform tows of vehicles from public property within the City limits; and WHEREAS,a t the May 3,2010 council meeting,staff presented to council the practical challenges with Ordinance No. 885; and WHEREAS,o n April 19,2011,the Mayor and City Council directed staff to begin the process of securing future towing services through an RFP/bid/contract; and WHEREAS,o n March 20,2011,the Mayor and City Council awarded bids to four tow companies and directed staff to prepare an ordinance repealing Ordinance No. 885. NOW THEREFORE,BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA, AS FOLLOWS: SECTION I REPEALING ORDINANCE NO. 885 All ordinances and parts of ordinances in conflict with the provisions of this ordinance or any part of the code adopted herein by reference, including but not limited to Ordinance No. 885 in its entirety, are hereby repealed. SECTION II REPEALING ANY CONFLICTING ORDINANCES All ordinances and parts of ordinances in conflict with the provisions of this ordinance or any part of the codes adopted herein by reference are hereby repealed. ORDINANCE NO. 1382 PAGE 1 OF 2 SECTION III PROVIDING FOR SEVERABILITY If any section,subsection,sentence,phrase,clause or portion of this ordinance o r any part of the code adopted herein b y reference is,for any reason,held to b e invalid or unconstitutional b y the decision of any court of competent jurisdiction,such decision shall not affect the validity of the remaining portions thereof. SECTION IV DECLARING AN EMERGENCY The immediate operation of the provision of this ordinance is necessary for the immediate preservation of the public peace, health or safety,and that an emergency is hereby declared to exist, and this ordinance shall be in full force and effect from and after its passage,adoption and approval by the Mayor and City Council of the City of Apache Junction.
