AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF
APACHE JUNCTION,ARIZONA,AMENDING APACHE JUNCTION CITY
CODE, VOLUME I, BY REPEALING CHAPTER 4:FEES,ARTICLE 4-
6:PUBLIC WORKS FEE SCHEDULE IN ITS ENTIRETY;AND
ADOPTING NEW CHAPTER 4:FEES,ARTICLE 4-6:PUBLIC WORKS
FEE SCHEDULE;REPEALING ANY CONFLICTING PROVISIONS;
PROVIDING FOR SEVERABILITY;ESTABLISHING AN EFFECTIVE
DATE; AND A REVOLVING SIXTY MONTH REVIEW PERIOD.
WHEREAS, the Mayor and City Council last approved an amended
public works fee schedule on February 1,2000 when it adopted
Ordinance No.1113 which added Article 4-6:Public Works Fee
Schedule to the Apache Junction City Code; and
WHEREAS, since that time, the City of Apache Junction Public
Works Department desires to update fees in order to be
commensurate with fees charged in the greater Phoenix metropolitan
area.
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL
OF THE CITY OF APACHE JUNCTION, ARIZONA, AS FOLLOWS:
SECTION I IN GENERAL
The Apache Junction City Code,Volume I, Chapter 4:Fees,Article
4-6:Public Works Fee Schedule is hereby amended in its entirety
to read as follows:
ARTICLE 4-6 PUBLIC WORKS FEE SCHEDULE
Roadway abandonment and right-of-way easement extinguishment
fees:
(A)Application and filing processing fee for abutting
industrial,commercial or multi -family property:$450 per
application;
(B) Application and filing processing fee for abutting
residential property: $350 per application; and
(C) Abandonment fee for abutting residential property:$100 per
application.
(D) Applicant shall,before any permit is issued,provide the
city with a fee to offset expenses incurred in connection with
processing and inspecting work.
(E) Development's plan review fees:

(G) Inspection for which no rate is specified will be determined
by the public works department.Inspections by the director of
public works for work performed on weekends, holidays and after
normal working hours must be requested in advance by the
applicant or contractor. Authorization to work must be mutually
agreed upon by the director of public works and the applicant
and/or contractor prior to the commencement of work.Fees for
overtime inspections are as follows:

(H) Requests for inspections or plan reviews beyond normal
working hours may be performed at the pleasure of the city as a
courtesy to the applicant and is not intended to be a mandated
service. This extra work may be performed by the city predicated
on the availability of manpower and the employee's agreement to
work accordingly providing their normal job requirements and
health are not negatively impacted.
SECTION II REPEALING ANY CONFLICTING PROVISIONS
All other ordinances and parts of ordinances in conflict with the
provisions of this ordinance or in conflict with any part of the
code adopted herein by reference are also hereby repealed.
SECTION III PROVIDING FOR SEVERABILITY
If any section, subsection, sentence, phrase, clause or portion of
this ordinance,or any part of the code adopted herein by
reference is for any reason held to be invalid,pre-empted or
unconstitutional by the decision of any court of competent
jurisdiction, such decisions shall not affect the validity of the
remaining portions thereof.

SECTION IV ESTABLISHING AN EFFECTIVE DATE
The provisions of this ordinance shall take effect on July 1,
2016 and before the end of each sixty month period thereafter,
staff shall review the fees and provide a recommendation to the
mayor and city council for any amendments.
