AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF
APACHE JUNCTION,ARIZONA,AMENDING APACHE JUNCTION CITY
CODE,VOLUME I,CHAPTER 4:FEES,ARTICLE 4-3,ANIMAL
CONTROL FEE SCHEDULE;REPEALING ANY CONFLICTING
PROVISIONS;PROVIDING FOR SEVERABILITY;PRESERVATION OF
RIGHTS FOR CURRENT CLASS 3 PERMIT HOLDERS;AND
ESTABLISHING AN EFFECTIVE DATE.
WHEREAS,pursuant to Arizona Revised Statutes Titles 9 and
11, cities and towns are authorized to regulate various aspects of
animal control; and
WHEREAS,the mayor and city council approved an amended
animal control fee schedule on April 15,2008 when it adopted
Ordinance No. 1311; and
WHEREAS, the mayor and city council last approved an amended
animal control fee schedule on June 16,2015 when it adopted
Ordinance No.1416 in which it decided to add a personal dog
kennel class 3 fee of $80 to allow a person under Apache Junction
City Code,Volume I, Chapter 6:Animals,Article 6, Section 6-1-8,
to own,maintain or harbor from nine to twelve dogs in the city
pursuant to Ordinance 1414 adopted on June 16, 2015; and
WHEREAS,the class 3 permit was only applied for by several
dog owners in the city; and
WHEREAS,one of the recipients of a class 3 permit did not
responsibly manage her 9-12 dogs and caused surrounding neighbors
extreme emotional stress; and
WHEREAS,it is now the desire of the mayor and city council
to reverse the 2015 legislation so that the number of dogs allowed
to be owned, maintained or harbored in the city limits is capped
at a reasonable level to no more than eight dogs,provided all
license fees are paid and remain current and health, noise, safety
and sanitation regulations are followed; and
WHEREAS,because the State of Arizona Department of
Agriculture regulates potbellied pigs and other livestock,the
city's potbellied pig license fees are also recommended to be
deleted from Chapter 6.
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL
OF THE CITY OF APACHE JUNCTION, ARIZONA, AS FOLLOWS:
SECTION I IN GENERAL

4-3,Animal Control Fee Schedule,is hereby amended in its
entirety to read as follows:

* The Director or his or her designee may waive adoption fees
during official adoption events in order to encourage adoptions
to reduce high inventories of animals.

** The Director or his or her designee may also request payment
for reasonable expenses relating to livestock adoptions.
SECTION II REPEALING ANY CONFLICTING PROVISIONS
All other ordinances and parts of ordinances in conflict with the
provisions of this ordinance or in conflict with any part of the
code adopted herein by reference are also hereby repealed.
SECTION III PROVIDING FOR SEVERABILITY
If any section, subsection, sentence, phrase, clause or portion of
this ordinance,or any part of the code adopted herein by
reference is for any reason held to be invalid,pre-empted or
unconstitutional by the decision of any court of competent
jurisdiction,such decisions shall not affect the validity of the
remaining portions thereof.
SECTION IV PRESERVATION OF RIGHTS FOR CURRENT CLASS 3
PERMIT HOLDERS
Individuals that hold a class 3 personal dog kennel permit prior
to the effective date of this ordinance may continue owning,
maintaining,or harboring 9-12 dogs provided they are up-to-date
on permit fees and dog licensing and may continue to renew their
permit until such time they decide to surrender such permit or
fail to pay the renewal charge of $80.00.
SECTION V ESTABLISHING AN EFFECTIVE DATE
The provisions of this ordinance shall be effective beginning
January Z, 2019.
