AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY
OF APACHE JUNCTION,ARIZONA,AMENDING THE APACHE
JUNCTION,ARIZONA,ZONING ORDINANCE,BY AMENDING THE
ZONING DISTRICT MAP, CITY OF APACHE JUNCTION, ARIZONA,
CHANGING THE ZONING DISTRICT CLASSIFICATION FOR THE
PROPERTIES DESCRIBED IN REZONING CASE PZ-1-18, A CITY-
INITIATED REZONING,FROM GENERAL COMMERCIAL ("B-1") TO
OLD WEST COMMERCIAL BY PLANNED DEVELOPMENT ("B-2/PD");
REPEALING ANY CONFLICTING PROVISIONS;AND PROVIDING
FOR SEVERABILITY.
WHEREAS, on May 6, 2014, pursuant to Ordinance No. 1402,
the city adopted a new zoning ordinance and zoning district
maps, and the subject properties were given a new zoning
designation of General Commercial ("B-1"); and
WHEREAS, due to small lot sizes, property owners and staff
have observed practical difficulties complying with "B-1"
requirements should future developments or redevelopments be
pursued; and
WHEREAS, for the purpose of alleviating these hardships
along the Ironwood business corridor, on October 17, 2017, as
recommended by planning staff, the mayor and city council
directed staff to initiate a corrective rezoning for the
corridor from "B-1" to "B-2/PD"; and
WHEREAS, the mayor and city council finds that the proposed
rezoning confarms to all of the applicable criteria as specified
in the Apache Junction City Code,Volume II,Land Development
Code,Chapter 1:Zoning Ordinance,Article 1-5:Zoning Bulk and
Use Regulations,Section 1-5-3,Non -Residential Use Regulations,
and Article 1-4:Zoning Districts,Section 1-4-3 Planned
Development ("PD") District.
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY
COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA, AS FOLLOWS:
SECTION I IN GENERAL

The zoning district classification on the Zoning District Map,
City of Apache Junction, Arizona,for the parcels of land
legally described as:
Lots 1 through 22,FRANCIS M.SCHMITZ BUSINESS LOT
SUBDIVISION,recorded in Book 9 of maps,Page 54,
records of Pinal County, Arizona; and
A part of the Northeast quarter of the Southeast
quarter of Section 19, Township 1 North,Range 8 East
of the Gila and Salt River Base and Meridian,Pinal
County,Arizona (also known as Pinal County Assessor
parcel number 101-09-120C); and
A part of the Southwest quarter of Section 20,
Township 1 North,Range 8 East of the Gila and Salt
River Base and Meridian,Pinal County,Arizona (also
known as Pinal County Assessor parcel numbers 101-16-
008,009A,010,011D,011C,012 and the west 115 feet
of parcel 101-16-013H and the west 125 feet of parcel
101-16-013J).
be and hereby are amended from General Commercial("B-1") to Old
West Commercial by Planned Development("B-2/PD"), subject to the
following conditions:
1. The bulk regulations for B-2 (Old West Commercial)
zoning district found in Apache Junction City Code,
Volume II,Land Development Code,Chapter 1:Zoning
Ordinance,Article 1-5:Zoning and Use Regulations,
Section 1-5-4 Non -Residential Bulk Regulations,Table 5-
4 Non -Residential Bulk Regulations,shall be modified to
allow for a 5 foot minimum front setback (all

2. The required 10 foot -wide planting strip found in Apache

Regulations,Section 1-8-6 Landscape Standards,shall be
reduced to a 5 foot -wide planting strip for any new
developments or redevelopments.
3. The number of parking stalls required in Apache Junction
City Code,Volume II Land Development Code,Chapter 1:
Zoning Ordinance,Article 1-7:Parking, Loading and
Circulation Regulations,Table 7-3 Number of Parking
Stalls Required,shall be reviewed on a case -by -case
basis, and shall be determined by the zoning
administrator, with a reduction allowed on net floor
area (which would exclude bathrooms, closets, utility
rooms, storage rooms, and similar spaces) and by the
following: 1) two bicycle stalls shall be the equivalent
of one parking stall; and 2) two motorcycle stalls shall
be the equivalent of one parking stall.
4. For any non -conforming lots or structures,Apache
Junction City Code,Volume II,Land Development Code,
Chapter 1:Zoning Ordinance,Article 1-2:Types of Uses,
Section 1-2-5 Nonconforming Uses, Structures and Lots,
shall apply.
5. A non -conforming use structure cannot expand beyond the
50% limitation, as found in Apache Junction City Code,
Volume II Land Development Code,Chapter 1:Zoning
Ordinance,Article 1-2:Types of Uses,Section 1-2-5
Nonconforming Uses, Structures and Lots.
6. All applicable permits shall be applied for and plans
shall be designed to current city codes for any
structures over 120 square feet, remodels, and new
developments.
7. All other regulations and city codes within the B-2 (Old
West Commercial) zoning district shall apply.
SECTION II REPEALING ANY CONFLICTING ORDINANCES

All ordinances and parts of ordinances in conflict with the
provisions of this ordinance or any part of the codes adopted
herein by reference are hereby repealed.
SECTION III PROVIDING FOR SEVERABILITY
If any section, subsection, sentence, phrase, clause or portion
of this ordinance or any part of the codes or regulations
adopted herein by reference is for any reason held to be invalid
or unconstitutional by the decision of any court of competent
jurisdiction, such decision shall not affect the validity of the
remaining portions thereof.
