AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF
APACHE JUNCTION,ARIZONA,ESTABLISHING AND ENACTING REGULATIONS
REGARDING THE USE OF SHIPPING CONTAINERS WITHIN THE CORPORATE
LIMITS;REPEALING ANY CONFLICTING PROVISIONS;PROVIDING FOR
SEVERABILITY;AND PROVIDING PENALTIES.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE
JUNCTION,ARIZONA,AS FOLLOWS:
SECTION I IN GENERAL
1.Definition of Shipping Container:"Shipping Container"shall mean a
unit originally or specifically used for or designed to store goods or
merchandise during shipping or hauling by a vehicle.
2.Prohibited Uses of Shipping Containers:
A.I t is hereby prohibited and unlawful to place or use any shipping
container as an accessory building,storage building or living unit
within the corporate city limits.
B.I t shall be unlawful for any person to place or cause to be placed or
use or permit the use of any shipping container as an accessory
building,storage building or living unit within the corporate city
limits.
3.Permitted Use of Shipping Containers:
A.Duly licensed and bonded contractors may utilize shipping containers
for the temporary housing of equipment and materials during
construction at a specific site provided such construction is
authorized by a valid city building permit.
B.Any shipping container located at a specific site within the corporate
limits of the City of Apache Junction upon the date of adoption of this
ordinance shall be allowed to remain in use,provided such use or
location does not change;no additional storage containers shall be
located within the City of Apache Junction upon the date of adoption of
this ordinance except as provided herein.

SECTION I I REPEALING ANY CONFLICTING PROVISIONS
All ordinances and parts of ordinances in conflict with the provisions of
this ordinance or any part of the code adopted herein by reference are hereby
repealed.
SECTION III PROVIDING FOR SEVERABILITY
I f any section,subsection,sentence,phrase,clause or portion of this
ordinance or any part of the code adopted herein by reference is,for any
reason,held to be invalid or unconstitutional by the decision of any court of
competent jurisdiction,such decision shall not affect the validity of the
remaining portions thereof.
SECTION IV PROVIDING FOR PENALTIES
Any person found guilty of violating any provision of this code,except as
otherwise provided in this code,shall be guilty of a misdemeanor and,upon
conviction thereof,shall be punished by a fine of not to exceed one -thousand
dollars,or by imprisonment for a period of not to exceed six months,or by both
such fine and imprisonment.Each day that a violation continues shall be a
separate offense punishable as hereinabove described.
