HomeMy WebLinkAboutORD645ORDINANCE NO.645 AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA,AMENDING THE APACHE JUNCTION,ARIZONA,ZONING ORDINANCE,BY AMENDING THE ZONING DISTRICT MAP,CITY OF APACHE JUNCTION,ARIZONA,CHANGING THE ZONING DISTRICT CLASSIFICATION IN REZONING CASE PZ-24-88 FROM TH/PD (TRAILER HOMESITE BY PLANNED DEVELOPMENT)TO CR-3/PD (SINGLE FAMILY RESIDENCE ZONE BY PLANNED DEVELOPMENT);REPEALING ANY CONFLICTING PROVISIONS;AND PROVIDING FOR SEVERABILITY. BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA,THAT: SECTION I IN GENERAL 1.The zoning district classification on the Zoning District Map,City of Apache Junction,Arizona,for the parcels of land described as: Sunny Lane Estates subdivision,in the City of Apache Junction,County of Pinal,State of Arizona,as per plat recorded in Cabinet A,Slide 78 in the Office of the County Recorder of said county.Also known as "Broadway Place." be and hereby is amended from TH/PD (Trailer Homesite by Planned Development)to CR-3/PD (Single Family Residence Zone by Planned Development). 2.Permitted uses and the arrangement of uses on the land shall be as permitted by the base zoning district,with the following exceptions and stipulations: a.Minimum lot size shall be as set forth on the approved subdivision plat for Sunny Lane Estates. b.The following minimum setbacks shall be required: 1.Front yard:17.84 feet. 2.Side yard:No side yard shall be less than 5 feet and one side yard shall not be less than 10 feet. 3.Rear yard:13.66 feet. c.One of the two required parking spaces for each dwelling unit shall be within the buildable area and shall be either covered or enclosed. d.Building height shall be limited to one story. e.Existing structures and uses shall be considered in conformance with zoning requirements. f .Maximum living area is to be 1,260 square feet livable. ORDINANCE NO.645 PAGE ONE OF TWO SECTION I I REPEALING ANY CONFLICTING PROVISIONS All ordinances and parts of ordinances in conflict with the provisions of this ordinance or any part of the code adopted herein by reference are hereby repealed. SECTION III PROVIDING FOR SEVERABILITY If any section,sub -section,sentence,phrase,clause or portion of this ordinance or any part of the code adopted herein by reference is for any reason held to be invalid or unconstitutional by the decision of the court of compe- tent jurisdiction,such decision shall not affect the validity of the remaining portion thereof.
