AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE
JUNCTION,ARIZONA,AMENDING THE APACHE JUNCTION CITY CODE,
CHAPTER 8 BUSINESS,ARTICLE 8-6 SWAP MEET OPERATIONS,SECTION
8-6-2 UNLAWFUL PRACTICES OF SWAP MEET PROPRIETOR,PERTAINING
TO THE DEPOSIT OF LICENSE FEES AND THE MAINTAINING OF VENDOR
RECORDS;REPEALING ANY CONFLICTING PROVISIONS;PROVIDING FOR
SEVERABILITY;PROVIDING FOR PENALTIES;AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE
JUNCTION,ARIZONA,AS FOLLOWS:
SECTION I IN GENERAL
That the Apache Junction City Code Chapter 8 BUSINESS,Article 8-6
Swap Meet Proprietor,Section 8-6-2 Unlawful Practices of Swap Meet
Proprietor,be amended by adding subsections L,M and N to read as follows:
Article 8-6 SWAP MEET PROPRIETOR
Section 8-6-2 Unlawful Practices of Swap Meet Proprietor
I t shall be unlawful for a swap meet proprietor to fail to comply
with the requirements of this article and,in particular:
L.To fail to immediately report and deposit with the City Clerk,
on the next regular city business day,all business license
deposit fees collected by the swap meet proprietor.
M.To fail to inquire of any vendor entering the premises of the
swap meet proprietor for the purpose of doing business,the
status of the vendor's compliance with current city business
license regulations.
N.To fail to maintain the appropriate records indicating each
swap meet vendor's compliance with current city business
license regulations.
SECTION I I REPEALING ANY CONFLICTING PROVISIONS
All ordinances and parts of ordinances in conflict with the provisions of this
ordinance,or any part of the code adopted herein by reference,is hereby
repealed.
SECTION III PROVIDING FOR SEVERABILITY
I f any section,subsection,sentence,clause,phrase or portion of this
ordinance or any part of the code adopted herein by reference is,for any
reason,held to be invalid or unconstitutional by any court of competent
jurisdiction,such decision shall not affect the validity of the remaining
portions thereof.

SECTION IV PROVIDING FOR PENALTIES
Any person found guilty of violating any provision of this code shall be
guilty of a misdemeanor and,upon conviction thereof,shall be punished by
a fine of not to exceed one -thousand dollars or by imprisonment for a period
of not to exceed six months,or by both such fine and imprisonment.Each
day that a violation continues shall be a separate offense punishable as
hereinabove described.
SECTION V DECLARING AN EMERGENCY
I t being necessary for the preservation of the peace,health and safety of the
City of Apache Junction,Arizona,that this ordinance become effective
immediately,an emergency i s hereby declared to exist and this ordinance
shall become effective immediately upon its passage and aDOPTION.
