AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE
JUNCTION,ARIZONA,AMENDING THE APACHE JUNCTION CITY CODE,
CHAPTER 11 PLANNING AND ZONING COMMISSION,SECTION 11-1-6 VOTING,
REPEALING ANY CONFLICTING PROVISIONS;PROVIDING FOR SEVERABILITY;
AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE
JUNCTION,ARIZONA,AS FOLLOWS:
SECTION I IN GENERAL
That the Apache Junction City Code,Chapter 11 PLANNING AND ZONING
COMMISSION,Section 11-1-6 Voting,be amended to read as follows:
Section 11-1-6 Voting
Four voting members shall constitute a quorum.A simple majority of
the quorum voting shall be required for passage of any matter before
the commission.The minutes of the meeting shall reflect the "ayes"
and "nays"cast on a particular measure and shall reflect the vote
of each member present.A member may abstain from voting only upon
a declaration that he has a conflict of interest,in which case such
member shall take no part in the deliberations on the matter in
question.
SECTION I I REPEALING ANY CONFLICTING PROVISIONS
All ordinances and parts of ordinances in conflict with the provisions of this
ordinance,or any part of the code adopted herin by reference,i s hereby
repealed.
SECTION III PROVIDING FOR SEVERABILITY
I f any section,subsection,sentence,clause,phrase orportion of this
ordinance or any part of the code adopted herein by reference is,for any
reason,heald to be invalid or unconstitutional by any court of competent
jurisdiction,such decision shall not affect the validity of the remaining
portions thereof.
SECTION IV DECLARING AN EMERGENCY
I t being necessary for the preservation of the peace,health and safety of
the City of Apache Junction,Arizona,that this ordinance become effective
immediately,an emergency i s hereby declared to exist and this ordinance
shall be come effective immediately upon its passage and adoption.

JUNCTION,ARIZONA,THIS 6TH DAY OF SEPTEMBER ,1988.
