AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,
ARIZONA,AMENDING THE APACHE JUNCTION,ARIZONA,ZONING ORDINANCE,BY AMENDING
THE ZONING DISTRICT MAP,CITY OF APACHE JUNCTION,ARIZONA,CHANGING THE ZONING
DISTRICT CLASSIFICATION IN REZONING CASE PZ-3-88 FROM GENERAL RURAL (GR)TO
GENERAL COMMERCIAL DISTRICT/PLANNED DEVELOPMENT (C-3/PD),LOCAL COMMERCIAL
DISTRICT/PLANNED DEVELOPMENT (C-2/PD),SINGLE FAMILY RESIDENCE ZONE/PLANNED
DEVELOPMENT (CR-2/PD),SINGLE FAMILY RESIDENCE ZONE/PLANNED DEVELOPMENT
(CR-3/PD),AND MULTIPLE FAMILY RESIDENCE ZONE/PLANNED DEVELOPMENT (CR-5/PD);
REPEALING ANY CONFLICTING PROVISIONS;AND PROVIDING FOR SEVERABILITY.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,
ARIZONA,THAT:
SECTION I IN GENERAL
The zoning district classification on the Zoning District Map,City of Apache
Junction,Arizona,for the parcels of land described as:
PARCEL "A"(from General Rural [GR]to General Commercial by Planned
Development [C-3/PD])
That portion of the southwest quarter of Section 29,Township 1 North,
Range 8 east of the Gila and Salt River Base and Meridian,Pinal County,
Arizona described as follows:
Commencing at the southwest corner of said Section 29,thence north

be and hereby is amended from General Rural (GR)to General Commercial
District/Planned Development (C-3/PD),Local Commercial District/Planned
Development (C-2/PD),Single Family Residence Zone/Planned Development
(CR-2/PD),Single Family Residence Zone/Planned Development (CR-3/PD),and
Multiple Family Residence Zone/Planned Development (CR-5/PD);subject to
the following stipulations:
I .That no more than a total of 541 dwelling units be allowed for this
planned development.
2.That only office usage be allowed on Parcel B.
3.That the property owner dedicate the west 50 feet,the south 50 feet,
the north 40 feet,and the east 40 feet along with cutoffs at the
intersections for roadway and associated purposes.
4.That the city retain the option of reviewing this planned development
in three years and stipulating any additional conditions or plan
changes in order for the project to comply with the standards that may
be in effect three years from now.The applicant will be required to
begin construction by September 20,1991,or obtain a time extension
from the City Council.
5.That the open space plan,its rationale,and calculations for 24 acres
of open space be submitted at the time of preliminary plan approval.

SECTION I I REPEALING ANY CONFLICTING PROVISIONS
All ordinances and parts of ordinances in conflict with the provisions of this
ordinance or any part of the code adopted herein by reference are hereby
repealed.
SECTION III PROVIDING FOR SEVERABILITY
If any section,sub -section,sentence,phrase,clause or portion of this
ordinance or any part of the code adopted herein by reference is for any reason
held to be invalid or unconstitutional by the decision of the court of
competent jurisdiction,such decision shall not affect the validity of the
remaining portion thereof.
