AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF
APACHE JUNCTION,ARIZONA,ADOPTING BY REFERENCE THE CITY
OF APACHE JUNCTION,ARIZONA,ANIMAL CONTROL PROCEDURES
MANUAL,AS DECLARED PUBLIC RECORD BY RESOLUTION NO.88-39,
REPEALING ANY CONFLICTING PROVISIONS;PROVIDING FOR
SEVERABILITY:
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY
OF APACHE JUNCTION,ARIZONA,AS FOLLOWS:
SECTION I IN GENERAL
That certain document entitled City of Apache Junction,Arizona,Animal
Control Procedures Manual,three copies of which are on file with the
office of the City Clerk,and which has been made a public record by the
adoption of Resolution No.88-39,is hereby adopted as i f fully set forth
in this ordinance.
SECTION I I REPEALING ANY CONFLICTING PROVISIONS
All ordinances and parts of ordinances in conflict with the provisions
of this ordinance or any part of the code adopted herein by reference
are hereby repealed.
SECTION III PROVIDING FOR SEVERABILITY
I f any section,subsection,sentence,clause,phrase or portion of this
ordinance or any part of the code adopted herein by reference is,for
any reason,held to be invalid or unconstitutional by any court of
competent jurisdiction,such decision shall not affect the validity of
the remaining portions thereof.

CHAPTER 1.000 eiNIMAL CONTROL; PURPOSE, DLiES & EQUIPMENT
.100 Purpose:
A.Animal Control shall provide to citizens of Apache
Junction courteous, effective animal control to ensure
that the rights of animal owners and non -owners, are
protected and served.
.200 Specific Duties:
A.The Animal Control Officer shall patrol the streets
and right-of-ways within he City of Apache Junction
in a radio equipped vehicle for the purpose of
animal control.
.201 Departmental Duties; Animal Control Officers shall:
A.Familarize themselves with City ordinances and State
laws regarding animals.
1.Prepare written reports of violations of such
ordinances and laws, and forward them to the
Department of Records Section for filing.
a.All reports of violations shall include
complete violation information (i.e.,
violation number including subseCtion
designation).
b.Fully document all pertinent violation
(citation) facts which may be required
later in court.
B.Prepare and forward written reports to the Administrative
Services Commander.
1.Animal Control Officers shall sign the necessary
court complaints to ensure compliance with the
law(s).
C.Prepare written reports, on the proper form, as soon
as possible, on animal bite incidents which occur
within the City limits.
D.Prepare a written report of any incident of non-
compliance or death of a biting animal.
E.Coffiply with the established radio procedures required
of all Departmental personnel, including checking
10-8, etc.

.202 Animal Control Duties; Animal Control Officers Shall:
A.Be alert for dogs at large on the streets and
right-of-ways of the City, and shall capture
and impound the dogs as strays.
1.Impound any dogs found at large on public
property.
B.Check all dogs which come under their control for
a current dog license and vaccination tag issued
by the City of Apache Junction, and take proper
action when dogs are found without tags.
C.Ensure that any biting animal is quarantined
according to the regulation concerning the
specific animal.
1.Any animal which dies during the quarantine
period shall be transported immediately to
the City pound for examination of the brain
for rabies.
D.Remove any dead animals, except for livestock, they
observe or are informed of, from the streets or
right-of-ways of the City.
1.The Animal Control Officer shall remove dead
animal(s) when such an animal is in public
view and/or would create a health hazard or
public nuisance if it were allowed to remain.
E.Destroy seriously injured or sick animals as may
be necessary by shooting the animal in such a
manner as to cause instant and painless death.
1.The Animal Control Officer shall use great care
to ensure that the immediate destruction of the
animal is necessary and that great care is
utilized in the use of the firearm.
.300 Animal Control Assignments:
A.Animal Control will be dispatched to calls as
needed.
.301 Response to Calls:
A.All "Priority calls will be handled as soon as
possible after being dispatched.
1.All other calls will be handled on an
availability basis.

.301 B.All calls where a complainant is to be contacted
shall be given priority over non -complainant type
calls.
C.The next oncoming Animal Control shift will check
and see if there are any calls holding or left from
the previous shift.
1.Holding calls will be .given a priority status.
.302 Personnel Assignments:
A.Duties will be as assigned by the Administrative
Services Commander.
.303 Animal Control Hours:
. 500
A.Normal Animal Control hours are; 8:00 a.m. to
5:00 p.m., seven days a week.On Monday,
Tuesday and Friday hours are until 8:00 p.m.
'Uniforms:
A.Blue shirt, blue hopsack pants, black boots.
Animal Control Vehicles:
A.All Animal Control vehicles will follow Police
Department policy.
. 501 Vehicle Operation:
A.Vehicles are not to be used recklessly and are not
to be driven on sidewalks, private driveways or
other areas where there is an increased risk of
accidentally injuring a human being.
. 502 .Vehicle Equipment & Maintenance:
A.Vehicles shall have the following items checked
and maintained daily:
1.Oil and transmission fluid levels and
power steering oi4.
2.Radiator water level (never check while hot).
3.-Windshild wipers and their water level.
4.All exterior lights and turn signals.

.503 Accidents Involving Departmental Vehicles:
A.Will be handled as per Police Department policy.
.600 Firearms Care:
A.The Animal Control Officers assigned firearms
shall not, under any circumstances, leave their
firearm in the vehicle overnight.
B.Animal Control Officers will be requird to attend
scheduled training shoots at least once a quarter.
C.All firearms will be carried with an empty chamber
and the safety on at all times.
CHAPTER 2.000 ANIMAL CONTROL; RESPONSIBILITIES
& DUTIES
.100 Dispatching of Animals:
A.In dispatching animals, the Animal Control
Officer shall:
1.Use great care to ensure that the immediate
destruction of the animal is Aecessary, and
shall exercise great care in the use of the
weapon.
2.Report all discharges of firearms in writing
to their supervisor, explaining the details
of the case.
B.Dispatching large animals (emergency situations):
1.Under normal circumstances, all dispatching
will be done by the Animal Control Officer.
2.The Animal Control Officer will request
assistance of a sworn officer to aid in
the dispatching of a large animal.
C.Dispatching large animals:
1.Large animals may be dispatched under the
following conditions:
a.The injuries will obviously be fatal
and the animal shows intense suffering.
b.The animal is an immediate danger to
persons, and dispatching is the only
reasonable solution.
c.Employees must receive approval from
their immediate supervisor prior to
dispatching any large animal.
.200 Cruelty to Animals:
A.The Animal Control Officer shall summon the
on -duty Sergeant when a situation involves
considerable investigation, reading of rights
to suspects or citing cruelty (13-2910).
B.The Sergeant will determine who, Animal Control
or Patrol, shall conduct the investigation, based
on all available facts, suspect information,
complexity of the situation, manpower availability,
potential hazard to unarmed non -sworn employees
and the number of Animal Control calls presently
holding.

.300 Large Animals Loose and/or Creating a Hazard:
A.Loose Large Animals:
1.Large animals running loose may be corralled
and tied.If the owner is not available to
take possession of the animal, officers shall
notify the Arizona Livestock Sanitary Board.
B.Large Animals Creating a Hazard:
1.If a large animal cannot be corralled or
tied, officers shall attempt to keep the
animal in an area where it will not create
a hazard, and contact the Livestock Board,
which has the necessary equipment and
personnel to capture and remove the animal
to a place of safety.
. 400 Animals in Parks:
A.Animal Control Officers shall actively patrol
Apache Junction parks and enforce the City
ordinances.
. 500 Bite Incidents, Reporting and Quarantine:
. 501 Reporting:
A.All officers are required to write a complete
report on any bite incident and it shall include
the following:
1.The name of the victim.
2.The part of the body bitten.
3.The name of the owner of the dog/cat or any
other bite animal.
4.Where the animal was located.
5.If an animal owner says that their animal
has had shots, verify the statement by
including a receipt and/or tag number
in the report.
.502 Rabies Quarantine Period:
A.The rabies quarantine period will be determined
from the first day of impoundment.
1.City statutes dictate dogs and cats are to
be confined and quarantined for a period of
not less than fourteen (14) days and all
other animals for a period of not less than
fourteen (14) days.

.502 B.Home Confinement:
1.Provisions are made for home confinement
of dogs depending on its license and/or
rabies vaccination.
a.If the animal owner wishes to confine
their dogs at home and can provide
proof that the dog has ben vaccinated,
they may do so.
2.Cats may be confined at home provided the
owner can produce valid certification of
vaccination.
a.Cats which have not been vaccinated
must be confined at the pound.
C.Home Quarantine Agreement:
1.State Law, Title 24-372, provides that any
animal suspected of biting a human being
must be confined and quarantined for a
period of fourteen (14) days for dogs and
cats, and fourteen (14) days for any other
animals susceptible to rabies.
2.Dogs must wear a license tag during home
quarantine.
3.The animal shall be confined on a chain or in
a yard, pen or cage surrounded by a fence or
wall adequate to prevent it from escaping, and
shall not be taken off the premises for
exercise or recreation of any kind during this
quarantine.
4.If the animal becomes sick during the period
of quarantine, the responsibile party agrees
to have it examined by a veterinarian
licensed to practice in the State of Arizona
and to have the veternarian furnish the
Apache Junction Police Department's Animal
Control unit (983-4405) with a report of the
animal's condition.
5.The responsible party warrants that all
information about the animal that is
furnished to Animal Control is true.
6.The animal may not leave the City limits
while under quarantine.

.502 C.7.The animal may not receive rabies vaccination
while under quarantine.
8.The animal is not actually off quarantine
until released by an Animal Control officer.
. 9.The parties agree that if the responsible
party violates any of the terms of the
quarantine set forth herein, the animal will
be impounded and quarantined in the care of
Rabies/Animal Control or a licensed
veterinarian at the expense of the responsible
party, and such party is also subject to
receiving a citation for violating the home
quarantine.
10.This agreement shall not be construed to be
an admission by the responsible party, that
the animal did, in fact, inflict an injury
on any person.
D.Quarantine Follow -Up:
1.Animal Control Officers shall follow-up cases
that involve the quarantine of any animal:
a.This follow-up shall determine if all the
requirements of the quarantine procedure
have been followed.
2.Under no circumstances shall any Animal
Control Officer forcibly entr any building
to check quarantine compliance.
a.Homes shall not be entered until permission
is granted by an adult or other responsible
party.

.600 Rabies Worksheets:
A.A rabies worksheet will accompany any animal sent
to the laboratory for rabies testing.
.700 Abandoned Animals
A.Anytime an Animal Control Officer takes any
animal into possession, regardless of type,
that animal shall be taken to the City pound
for impoundment.
1.Animal Control Officers shall not "give away"
any animal(s) in their possession, to any
person prior to the animal(s) impoundment.
2.Individuals wishing to take control of the
•said animal(s) shall be directed to the
City pound and required to follow the
established procedure.
