AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,
ARIZONA,REPEALING SECTIONS 5.73 A.,B.,C.;5.76,5.77,5.79,5.80,5.82,
5.83 AND 5.84;VEHICLE OPERATIONS,OF THE APACHE JUNCTION POLICE POLICIES
AND PROCEDURES,AND ALLOWING FOR GENERAL ORDER NO.6.31,OPERATION OF
DEPARTMENTAL VEHICLES;REPEALING ANY CONFLICTING PROVISIONS;AND PROVIDING
FOR SEVERABILITY.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE
JUNCTION,ARIZONA,THAT:
SECTION I IN GENERAL
That Chapter Five,Sections 5.73 A.,B.,C.,Emergency Response;5.76
Pursuits;5.77 Initiating Pursuits;5.79 Assisting Units;5.80
Barricading Roadways;5.82 Ramming/Bumping;5.83 Unmarked Units;5.84
Motorcycle Pursuits,be repealed to allow for a more thorough Departmental
Vehicle Operation Policy to be initiated.
Furthermore,the Director of Public Safety is empowered to initiate an
updated and more thorough Departmental Vehicle Operation Policy.
SECTION I I REPEALING ANY CONFLICTING PROVISIONS
All ordinances and parts of ordinances in conflict with the provisions of
this ordinance or any part of the Police Policies and Procedures adopted
herein by reference,are hereby repealed.
SECTION III PROVIDING FOR SEVERABILITY
If any section,sub -section,sentence,phrase,clause or portion of this
Ordinance or any part of the code adopted herein by reference is for any
reason held to be invalid or unconstitutional by the decision of any court
of competent jurisdiction,such decision shall not affect the validity of
the remaining portion thereof.
