HomeMy WebLinkAboutORD675ORDINANCE NO.675 AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA,AMENDING THE APACHE JUNCTION,ARIZONA,ZONING ORDINANCE,BY AMENDING THE ZONING DISTRICT MAP,CITY OF APACHE JUNCTION,ARIZONA,CHANGING THE ZONING DISTRICT CLASSIFICATION IN REZONING CASE PZ-1-89 FROM GR GENERAL RURAL TO CR-2(MH)SINGLE FAMILY RESIDENCE/MANUFACTURED HOMES;REPEALING ANY CONFLICTING PROVISIONS;AND PROVIDING FOR SEVERABILITY. BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA,THAT: SECTION I IN GENERAL The zoning district classification on the Zoning District Map,City of Apache Junction,Arizona,for the parcels of land described as: That portion of Lot 26 of Section 18,Township 1 North,Range 8 East of the Gila and Salt River Base and Meridian,Pinal County,Arizona; COMMENCING at the Southwest corner of Lot 26,Section 18,Township 1 North, Range 8 East,Pinal County,Arizona; thence North 0 0 03'55"East along the Westerly Section line of the said Section 18,a distance of 168.50 feet to a point on the said Westerly Section line from which the Northwest corner of the said Lot 26,Section 18,bears North 0 0 03'55"East 161.50 feet distant therefrom; thence North 89 °58'00"East,a distance of 212.17 feet to the TRUE POINT OF BEGINNING; thence North 0 0 01'52"East,a distance of 128.51 feet to a point which is 33.00 feet Southerly of the Northerly line of the said Lot 26,Section 18; thence North 89 °57'53"East,being parallel to and 33.00 feet Southerly of the said Northerly line of Lot 26,Section 18,a distance of 179.10 feet; thence South 0 °00'12"East,being parallel to the Easterly line of the said Lot 26,a distance of 128.52 feet; thence South 89 °58'00"West,a distance of 179.17 feet to the TRUE POINT OF BEGINNING; EXCEPTING all oil,gas and other mineral deposits unto the United States as set forth in Docket 319,page 268 in the Patent to said land. be and hereby is amended from GR General Rural to CR-2(MH)Single Family Residence/Manufactured Homes subject to the following stipulations: ORDINANCE NO.675 PAGE ONE OF TWO 1.The applicants dedicate the south five feet (5')of the subject site for roadway and associated purposes. 2.The applicant remove any existing improvements from dedicated rights -of -way prior to lot split approval. 3.The applicants dedicate the north thirty-three feet (33')of the following described property for roadway and associated purposes: North thirty-three feet (33')of the North 161.5 feet of the East 179.25 feet of the West 391.5 feet of Lot 26 of the Northwest quarter of the Southwest quarter of Section 18,Township 1 North,Range 8 East,Gila and Salt River Base and Meridian,Pinal County,Arizona. SECTION I I REPEALING ANY CONFLICTING PROVISIONS All ordinances and parts of ordinances in conflict with the provisions of this ordinance or any part of the code adopted herein by reference are hereby repealed. SECTION III PROVIDING FOR SEVERABILITY I f any section,sub -section,sentence,phrase,clause or portion of this ordinance or any part of the code adopted herein by reference is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction,such decision shall not affect the validity of the remaining portion thereof.
