AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,
ARIZONA;ESTABLISHING THE SPEED LIMIT ON IDAHO ROAD BETWEEN SHIPROCK
STREET AND SMOKETREE STREET;REPEALING ANY CONFLICTING PROVISIONS;
PROVIDING FOR SEVERABILITY;PROVIDING FOR PENALTIES;AND DECLARING AN
EMERGENCY.
BE ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,
ARIZONA THAT:
SECTION I IN GENERAL
I t is in the public interest to insure safe,effective and efficient traffic
flow along public rights—of—way within the City of Apache Junction,Arizona,
and i t has been determined that speed limits are necessary for the public
safety and convenience to modify speed limits.Now,therefore be it ordained
that speed limit on Idaho Road,between Shiprock Street and Smoketree Street
shall remain 35 MPH.
During the time when school is in session,the speed will be reduced to 15 MPH
and will be regulated by portable speed signs placed in the roadway.
Furthermore,the Director of Public Works and the Director of Public Safety are
hereby empowered and directed to initiate appropriate action to install the
speed limit signs and enforce the speed limit on the referenced street.
SECTION I I REPEALING ANY CONFLICTING PROVISIONS
All ordinances and parts of ordinances in conflict with the provisions of this
ordinance,or any part of the code adopted herein by reference,are hereby
repealed.
SECTION III PROVIDING FOR SEVERABILITY
I f any section,subsection,sentence,phrase,clause or portion of this
ordinance,or any part of the code adopted herein by reference,is for any
reason held to be invalid or unconstitutional by the decision of any court of
competent jurisdiction,such decision shall not affect the validity of the
remaining portions thereof.
SECTION IV PENALTY CLAUSE
Any person found guilty of any violation of or failure or refusal to do or
perform any act required by Chapter 12 of this code constitutes a civil traffic
violation.Civil traffic violations are subject to the provisions of Title 28,
Chapter 6,Article 20 and 21,Arizona Revised Statute,and amendments thereof.

SECTION V EMERGENCY CLAUSE
I t is necessary for the preservation of the peace,health and safety of the
City of Apache Junction,Arizona,that this ordinance become effective
immediately,an emergency is hereby declared to exist and this ordinance shall
be effective immediately upon passage and adoption.
