AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,
ARIZONA;ESTABLISHING THE SPEED LIMIT ON WINCHESTER ROAD BETWEEN SCENIC
STREET AND BROADWAY AVENUE AND ON DELAWARE DRIVE BETWEEN LOST DUTCHMAN
BOULEVARD AND 16TH AVENUE;REPEALING ANY CONFLICTING PROVISIONS;PROVIDING
FOR SEVERABILITY;PROVIDING FOR PENALTIES;AND DECLARING AN EMERGENCY.
BE ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,
ARIZONA THAT:
SECTION I IN GENERAL
I t is in the public interest to insure safe,effective and efficient traffic
flow along public rights—of—way within the City of Apache Junction,Arizona,
and i t has been determined that speed limits are necessary for the public
safety.Now,therefore be it ordained that speed limits be established as
follows:
Winchester Road
Winchester Road
Delaware Drive
Delaware Drive
Delaware Drive
Delaware Drive
—Scenic Street to US 60 35 MPH
—US 60 to Broadway Avenue 30 MPH
—Lost Dutchman Boulevard to Superstition Boulevard 35 MPH
—Superstition Boulevard to US 60 30 MPH
—US 60 to Broadway Avenue 35 MPH
—Broadway Avenue to 16th Avenue 30 MPH
Furthermore,the Director of Public Works and the Director of Public Safety are
hereby empowered and directed to initiate appropriate action to install speed
limit signs and enforce the speed limit on the referenced streets.
SECTION I I REPEALING ANY CONFLICTING PROVISIONS
All ordinances and parts of ordinances in conflict with the provisions of this
ordinance,or any part of the code adopted herein by reference,are hereby
repealed.
SECTION III PROVIDING FOR SEVERABILITY
I f any section,subsection,sentence,phrase,clause or portion of this
ordinance,or any part of the code adopted herein by reference,is for any
reason held to be invalid or unconstitutional by the decision of any court of
competent jurisdiction,such decision shall not affect the validity of the
remaining portions thereof.
SECTION IV PENALTY CLAUSE
Any person found guilty of any violation of or failure or refusal to do or
perform any act required by Chapter 12 of this code constitutes a civil traffic
violation.Civil traffic violations are subject to the provisions of Title 28,
Chapter 6,Article 20 and 21,Arizona Revised Statute,and amendments thereof.

SECTION V EMERGENCY CLAUSE
I t is necessary for the preservation of the peace,health and safety of the
City of Apache Junction,Arizona,that this ordinance become effective
immediately,an emergency is hereby declared to exist and this ordinance shall
be effective immediately upon passage and adoption.

JUNCTION,ARIZONA,THIS 6TH DAY OF AUGUST ,1991.
