AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF
APACHE JUNCTION,ARIZONA,AMENDING THE APACHE JUNCTION CITY CODE,
CHAPTER 7 BUILDING,ARTICLE 7-1-8 MECHANICAL CODE BY REPEALING THE
EXISTING SECTION 103 AND ENACTING A NEW SECTION OF LIKE NUMBER,
REPEALING ANY CONFLICTING PROVISIONS AND PROVIDING FOR SEVERABILITY.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE
JUNCTION,ARIZONA AS FOLLOWS:
SECTION I IN GENERAL
That Chapter 7 BUILDING,Article 7-1-8 MECHANICAL CODE Section 103 Scope be
repealed in its entirety and be replaced with a new section of like number to
read as follows:
Scope
Sec.103.The provisions of this code shall apply to the erection,
installation,alteration,repairs,relocation,replacement,addition
to,use or maintenance of any heating,ventilating,cooling,
refrigeration systems,incinerators or other miscellaneous heat-
producing appliances within this jurisdiction.Mechanical equipment
and systems in detached one-and two-family dwellings shall comply
with the requirements of Part IV of the One and Two Family Dwelling
Code referenced by Part I of Appendix Chapter 12 of the Building Code
when such appendix chapter is specifically adopted.
Additions,alterations,repairs and replacement of equipment or
systems shall comply with the provisions for new equipment and systems
except as otherwise provided in Section 104 of this code.
Where,in any specific case,different sections of this code specify
different materials,methods of construction or other requirements,
the most restrictive shall govern.
The Uniform Mechanical Code Standards and Uniform Building Code
Standards contained in Appendix A shall be considered as part of this
code.
Appendix B contains recommended practices which shall not apply unless
specifically adopted.
Appendix C contains gas -venting tables and a list of recommended
standards and is intended to serve only as a guide.The design and
testing of equipment regulated by this code shall be subject to the
approval of the building official.

Exception
Required equipment,and appliances and requirements regarding
necessity or serviceability of equipment or appliances shall be made
and enforced pursuant to the current intergovernmental agreement
between the City of Apache Junction and Pinal County,or such
agreement as is then in effect.In cases where this intergovernmental
agreement applies,this code shall be used as minimum installation
requirements.
SECTION I I REPEALING ANY CONFLICTING PROVISIONS
All ordinances and parts of ordinances in conflict with the provisions of this
ordinance or any part of the code adopted herein by reference are hereby
repealed.
SECTION III PROVIDING FOR SEVERABILITY
I f any section,subsection,sentence,phrase,clause or portion of this
ordinance or any part of the code adopted herein by reference is,for any
reason,held to be invalid or unconstitutional by any court of competent
jurisdiction,such decision shall not affect the validity of the remaining
portions thereof.
