AN ORDINANCE OF THE MAYOR'AND CITY COUNCIL OF THE CITY
OF APACHE JUNCTION,ARIZONA,AMENDING ARTICLE 2-11 OF THE
APACHE JUNCTION CITY CODE;PROVIDING FOR CONFLICTING
PROVISIONS;PROVIDING FOR SEVERABILITY;AND DECLARING AN
EMERGENCY.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE
JUNCTION,ARIZONA,AS FOLLOWS:
SECTION I IN GENERAL
That Article 2-11 Community Health Commission,Sections 2-11-1
through 2-11-8 be amended to read as follows:

Section 2-11-1 Creation
Members
The Health and Human Services Commission of the City of Apache Junction,
Arizona,i s hereby created.Staff responsiblities shall be assigned
through the City Manager's Office.
Section 2-11-2 Membership and Terms of Office
A.The Health and Human Services Commission shall consist of seven members
who shall be appointed by the Mayor and approved by the City Council.
B.The appointments to this Commission shall be for terms of three years
each with the terms of members so staggered so that the terms of office
of no more than three members shall expire in any one year.The
initial appointments shall be for two members with terms -beginning
upon their appointment and expiring on June 30,1992;for two members
with terms beginning upon their appointment and expiring on June 30,
1991;and three members with terms beginning upon their appointment
and expiring on.June 30,1990.'Thereafter,upon expif•ation.of -the
term of office,all new appointments shall be appointed for full three
year terms,except that in the event of death or resignation of a
member,the vacancy shall be filled by appointment of the Mayor,
subject to the approval of the City Council,for the unexpired term.

C;All members shall be residents of the City of Apache Junction.
D.No individual shall be appointed to the Commission i f such individual
has received funding from the City of Apache Junction either as an
individual,or i f such person has served on the board of any agency
or been the employee of any agency that has received funding from the
City of Apache Junction at any time during the preceding twelve months.
E.No former member of the Health and Human Services Commission shall make
application to the City of Apache Junction for funding as an individual
or as the employee or representative of any agency within twelve months
after they have ceased to be a member of the commission.
Section 2-11-3 Compensation and Expenses
The members of the Health and Human Services Commission shall receive no
salaries or other remuneration for their services as members of said
commission and shall not be entitled to personal expenses incurred by
them in the discharge of their official duties except to the extent,
purposes and amount such expense i s first authorized and approved in
advance by the City Council.
Section 2-11-4 Officers
The Commission shall elect a chairman and vice chairman from among its
members to serve for a period of one year.The vice chairman shall preside
at Commission meetings in the absence of the chairman.
Section 2-11-5 Duties
The Health and Human Services Commission of the City of Apache Junction,
Arizona,i s hereby charged with the following duties:
A.To conduct public hearings to determine the needs of city residents
with regard to public health needs,provision of human services,and
care of the elderly,handicapped and developmentally disabled.
B.To enhance the development of the public health through public forums,
seminars,and work with other agencies.
C.To review requests submitted by health and human service providers
(non-profit agencies)for city funding and to make recommendations to
the City Council regarding such funding.
D.To assist in the development of health care facilities.
E.To make recommendations to the City Council regarding elderly health
care and emergency transportation programs.

Section 2-11-6 Meetings
The Commission shall establish a regular meeting date which 'shall be placed
on file in the office of the City Clerk.Special meeting may be called by
the chairman.A quorum shall consist of four members for the transaction
of all business.
Section 2-11-7 Vacancies
Vacancies shall be filled in accordance with the provisions of Section 2-11-2
for the unexpired term of the member affected.
Section 2-11-8 Removal of Members
Members of the Commission shall serve at the pleasure of the City Council
and may be removed from office by the mayor with concurrence of a majority
of the City Council.A member of Commission shall not be absent from more
than three consecutive meetings.I f such an absence occurs,the remaining
members of the Commission shall vote to retain or recommend to the City
Council that the absentee member be relieved of his duties on the Commission.
SECTION I I REPEALING ANY CONFLICTING PROVISIONS
All ordinances and parts of ordinances in conflict with the provisions of
this ordinance or any part of the code adopted herein by reference are
hereby repealed.
SECTION III PROVIDING FOR SEVERABILITY
I f any section,sub -section,sentence,phrase,clause,or portion of this
ordinance or any part of the code adopted herein by reference is for any
reason held to be invalid or unconstitutional by the decision of any
court of competent jurisdiction,such decision shall not affect the
validity of the remaining portions thereof.
SECTION IV EMERGENCY CLAUSE
I t is necessary for the preservation of the peace,health,and safety of
the City of Apache Junction,Arizona,that this ordinance become effective
immediately,an emergency i s declared to exist,and this ordinance shall
be effective immediately upon passage and adoption.
