AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF
APACHE JUNCTION,ARIZONA,AMENDING THE APACHE JUNCTION
CITY CODE,CHAPTER 8 BUSINESS,ARTICLE 8-6 SWAP MEET
OPERATIONS,PERTAINING TO LICENSE REQUIREMENTS FOR SWAP
MEET PROPRIETORS AND SWAP MEET VENDORS;REPEALING ANY
CONFLICTING PROVISIONS;AND PROVIDING FOR SEVERABILITY.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE
JUNCTION,ARIZONA,AS FOLLOWS:
SECTION I IN GENERAL
That the Apache Junction City Code,Chapter 8 Business,Article 8-6 Swap Meet
Operations,be amended to read as follows:
Section 8-6-1 Definitions
That Subsection M be amended to read as follows:
M."Swap Meet Vendor"means any person located upon the premises of a swap
meet for the purpose of causing the advertisement of or making a sale
at a swap meet.
That Section 8-6-2 Unlawful Practices of Swap Meet Proprietor,Subsection N
be amended to read as follows:
N.To fail to maintain the appropriate records indicating each swap meet
vendor's compliance with current city business license regulations with
the exception of the filing of the gross sales reports.
That Section 8-6-3 Unlawful Practices of Swap Meet Vendors,Subsection A,be
amended to read as follows:
I t is unlawful for a swap meet vendor to fail to comply with the
requirements of this chapter and,in particular:
A.To fail to file with the city a report of all retail and wholesale
transactions,calculated on a daily basis,and based upon the swap meet
vendors'daily gross receipts.Such reports shall be filed with the
City Clerk's office on not less than a monthly basis with each filing
to occur no later than the sixth day following the end of each month.
Such filing of these gross sales reports,on a monthly basis,shall
commence on February 1,1990.

That Section 8-6-8 Schedule be amended to read as follows:
Subsection E.2.(a)
If the lease or rental of such space or stall occurs when city offices
are not open for business,such vendor shall be required to (a)pay to
the swap meet proprietor a city space rental fee in the amount of $1.00
per day for each space or stall leased or rented;(Subsections (b)and
(c)to remain as written).
Subsection F.,Paragraph 2:
Vendors under this subsection shall pay to the swap meet proprietor a
city space rental fee in the amount of $1.00 per day for each space or
stall rented or leased.When any such vendor listed under this
subsection reaches the maximum number of days permitted,such vendor
shall be required to comply with the licensing requirements of this
section.
SECTION I I REPEALING ANY CONFLICTING PROVISIONS
All ordinances and parts of ordinances in conflict with the provisions of this
ordinance or any part of the code adopted herein by reference are hereby
repealed.
SECTION III PROVIDING FOR SEVERABILITY
I f any sectin,subsection,sentence,phrase,clause or portion of this ordinance
or any part of the code adopted herein by reference is,for any reason held to
be invalid or unconstitutional by any court of competent jurisdiction,such
decision shall not affect the validity of the remaining portions thereof.
