AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,
ARIZONA,AMENDING THE APACHE JUNCTION,ARIZONA,ZONING ORDINANCE,BY AMENDING
THE ZONING DISTRICT MAP,CITY OF APACHE JUNCTION,ARIZONA,CHANGING THE ZONING
DISTRICT CLASSIFICATION IN REZONING CASE PZ-15-89 FROM GR GENERAL RURAL TO
CR-2(MH)SINGLE FAMILY RESIDENCE/MANUFACTURED HOUSING;REPEALING ANY
CONFLICTING PROVISIONS;AND PROVIDING FOR SEVERABILITY.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,
ARIZONA,THAT:
SECTION I IN GENERAL
The zoning district classification on the Zoning District Map,City of Apache
Junction,Arizona,for the parcels of land described as:
The South 164.76 feet of the East half of the Southeast quarter of the
Southwest quarter of the Southwest quarter of Section 27,Township 1 North,
Range 8 East,Gila and Salt River Base and Meridian,Apache Junction,Pinal
County,Arizona.
be and hereby is amended from GR General Rural to CR-2(MH)Single Family
Residence/Manufactured Housing;subject to the following stipulations:
1)Upon approval of the rezoning,applicants will dedicate the east and
west 33 feet,and the south 50 feet for present and future rights -of-
way,along with 20'x 20'cutoffs;
2)Because of an existing nonconforming use,a storage shed,rezoning is
subject to automatic reversion upon a 180 -day time limit,from the
effective date of the rezoning,unless improvements to the property are
made (per A.R.S.9-462.01[D]).The improvement requirements are
outlined below:
a)The property must be improved with a properly placed main building
(see #3 below)in order to bring the shed into conformance with
the provisions of the Zoning Ordinance prior to the time limit
expiration date;OR
b)The shed must be removed prior to the time limit expiration date;
3)At the time of improvements,regardless of whether or not the property
has been split,the main building must be placed on the property in
such a manner that it will not make the existing storage shed fall into
non-compliance with the provisions of the Zoning Ordinance,Section
6.0116 Accessory Buildings and Storage Sheds.I f such a placement is
not possible,then the shed will have to be removed or relocated;

SECTION I I REPEALING ANY CONFLICTING PROVISIONS
All ordinances and parts of ordinances in conflict with the provisions of this
ordinance or any part of the code adopted herein by reference are hereby
repealed.
SECTION III PROVIDING FOR SEVERABILITY
I f any section,sub -section,sentence,phrase,clause or portion of this
ordinance or any part of the code adopted herein by reference is for any reason
held to be invalid or unconstitutional by the decision of any court of
competent jurisdiction,such decision shall not affect the validity of the
remaining portion thereof.
