HomeMy WebLinkAboutORD720ORDINANCE NO.720 AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,ARIZONA,AMENDING THE APACHE JUNCTION CITY CODE,CHAPTER 2 MAYOR AND COUNCIL,ARTICLE 2-4 COUNCIL PROCEDURE, SECTION 2-4-2 SPECIAL MEETINGS;SECTION 2-4-5 AGENDA AND CHAPTER 3 ADMINISTRATION,ARTICLE 3-1 CITY MANAGER,ARTICLE 3-1-6 ACTING CITY MANAGER;REPEALING ANY CONFLICTING PROVISIONS AND PROVIDING FOR SEVERABILITY. BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,ARIZONA,AS FOLLOWS: SECTION I IN GENERAL That the Apache Junction City Code,Chapter 2 MAYOR AND COUNCIL,Article 2-4 COUNCIL PROCEDURE,Section 2-4-2 Special Meetings and Section 2-4-5 Agenda,be amended to read as follows: Section 2-4-2 Special Meetings The mayor or the city manager,upon the approval of four members of the council,or four members of the city council,may convene the council at any time by notifying the members of the council of the date,hour and purpose of such special meeting.The public shall be given at least twenty-four hours notice of any such special meeting by the posting of such notice in at least three public places and preparation of an agenda in accordance with A.R.S.§38-431.09 as amended;except that in the case of an actual emergency,a meeting may be held upon such notice as is appropriate for the circumstances in accordance with A.R.S.§431.02 as amended. Section 2-4-5 Agenda Prior to each council meeting or on or before a time fixed by the council for preparation and distribution of an agenda,whichever is earlier,the city manager shall collect all written reports,communications,ordinances, resolutions,contracts and other documents which are to be submitted to the council,and shall prepare an agenda according to the order of business.A copy of the agenda and pertinent material,as approved by the city manager, shall be furnished to the mayor and council,city manager,each department and the city attorney by the city clerk. That the Apache Junction City Code Chapter 3 ADMINISTRATION,Article 3-1 CITY MANAGER,Section 3-1-6 Acting City Manager,be amended to read as follows: ORDINANCE NO.720 PAGE ONE OF TWO Section 3-1-6 Acting City Manager A.In the event of the absence or disability of the city manager,the powers and duties of that office shall devolve upon such person as the city manager shall designate. B.In the event of a vacancy i n the office of city manager such as that created by termination,resignation or death,the council may assign the powers and duties of the office of city manager to another person until such time that the manager shall be replaced. I f such circumstances occur,the council shall be obligated to immediately commence proceedings to seek a permanent replacement for the city manager. SECTION I I REPEALING ANY CONFLICTING PROVISIONS All ordinances and parts of ordinances i n conflict with the provisions of this ordinance or any part of the code adopted herein by reference are hereby repealed. SECTION III PROVIDING FOR SEVERABILITY I f any section,subsection,sentence,phrase,clause or portion of this ordinance or any part of the code adopted herein by reference is,for any reason,held to be invalid or unconstitutional by any court of competent jurisdiction,such decision shall not affect the validity of the remaining portions thereof.
