HomeMy WebLinkAboutORD724ORDINANCE NO.724 AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,ARIZONA,AMENDING THE APACHE JUNCTION CITY CODE,CHAPTER 3 ADMINISTRATION,ARTICLE 3-2 OFFICE OF CITY CLERK;DELETING ARTICLE 3-3 OFFICE OF DEPUTY CITY CLERK AND ADOPTING IN LIEU THEREOF A NEW ARTICLE 3-3 DEPARTMENT OF FINANCE;AND DELETING ARTICLE 3-4 DEPARTMENT OF ADMINISTRATIVE 3EKVTas;REPEALING ANY CONFLICTING PROVISIONS;AND PROVIDING FOR SEVERABILITY. BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,ARIZONA,AS FOLLOWS: SECTION I IN GENERAL That the Apache Junction City Code,Chapter 3 Administration,Article 3-2 Office of City Clerk,be amended to read as follows: Article 3-2 Department of City Clerk Section 3-2-1 Department Established Section 3-2-2 Bond Section 3-2-3 Powers and Duties Section 3-2-4 Vacancies Section 3-2-5 Divisions Within the Department of City Clerk Section 3-2-6 Deputy City Clerk Section 3-2-1 Department Established The department of the city clerk of the City of Apache Junction is hereby created and established.I t shall be the duty of the city clerk to attend all meetings of the council unless at his request he is excused therefrom by the mayor individually or by the council,and shall be responsible for recording the minutes and presenting them to the council for approval. The department of the city clerk shall consist of the city clerk,who shall be head of the department,and all other officers and employees assigned thereto. All such officers and employees shall perform their duties subject to the supervision of the city clerk,who shall report directly to the city manager. The city clerk shall supervise the department in accordance with applicable ORDINANCE NO.724 PAGE 1 OF 5 personnel ordinances and shall exercise such powers and perform such duties as are conferred and required by applicable ordinance,resolution,or other lawful directives.The city clerk shall be appointed and removed by the city manager subject to ratification of the council,and shall serve and receive such compensation as shall be determined in accordance with applicable personnel ordinances. Section 3-2-2 Bond Before entering upon his duties of office,the city clerk shall execute a bond In such amount as is provided by statute,conditioned upon the faithful performance of his duties.Any premium for such bond shall be a proper charge against the city. Section 3-2-3 Duties A.Signatures.The city clerk shall seal and attest all contracts of the city and all licenses,permits and such other documents as shall require the formality. B.Money Collected.The clerk shall turn over all money received by him on behalf of the city to the city finance officer promptly upon receipt of the same;and with such money he shall give a statement as to the source thereof. C.Records.In addition to the record of ordinances and other records which the clerk is required by statute to keep,he shall keep a register of all licenses and permits issued and payments thereon;a record showing all of the officers of the city;a record showing all appointed board and commission members;and such other records as may be required by the council. D.Seal.The clerk shall be the custodian of the city seal and shall affix its impression on documents whenever this is required. E.Documents.The clerk shall be the custodian of all documents belonging to the city which are not assigned to the custody of some other officer. F.Indices.The clerk shall keep and maintain a proper index to all documents and records kept by him,so that ready access thereto and use thereof may be had. G.Elections.The clerk shall be the chief elections officer of the city,and shall perform all duties assigned in accordance with State statute and local ordinance. H.Licensing and Taxation.The clerk shall be responsible for coordinating city business license and sales tax collection programs in accordance with State statute and local ordinance. ORDINANCE NO.724 PAGE 2 OF 5 I .Ex Officio Treasurer.The city clerk shall be designated ex officio treasurer in accordance with Arizona Revised Statutes §9-271 (3)(a) J.Additional Duties.In addition to the duties herein provided the clerk shall perform such other duties and functions as may be required by statute or ordinance. Section 3-2-4 Vacancies In case the office of city clerk shall become vacant for any reason,the city manager shall appoint a successor subject to ratification of the council. Section 3-2-5 Divisions Within the Department There are hereby created within the Department of City Clerk the division of licensing and sales tax collections.Any division superintendents and section heads shall be appointed and removed by the city clerk,subject to ratification of the city manager and the provisions of Article 3-10 of this Code as i t now exists,or may hereafter be amended. Section 3-2-6 Deputy City Clerk A.The city clerk shall appoint a deputy city clerk(s)who shall have the power and duty to execute all documents required by any law or ordinance to be executed by the clerk,and affix the seal of the city thereto whenever required. B.When signing any documents the deputy city clerk(s)shall sign the name of the city clerk followed by the word "By"and the deputy clerk's own name and the words "deputy clerk". C.The power and duties herein described shall be exercised by such deputy clerk(s)only in the absence of the city clerk from his office in the city hall,and only when either written direction has been given by the city clerk to exercise such power,or the manager has determined that the city clerk is temporarily or permanently incapacitated to perform such function. D.Such deputy clerk(s)shall have the authority and power herein described, and such further power and authority as may be provided by statute. Article 3-3 Department of Finance Section 3-3-1 Section 3-3-2 Section 3-3-3 Department Established Powers and Duties Vacancies Section 3-3-1 Department Established There is hereby created the department of finance.This department shall consist of the director of finance who shall be the head of the department and ORDINANCE NO.724 PAGE 3 OF 5 all other officers and employees assigned thereto.All such officers and employees shall perform their duties subject to the supervision of the director of finance who shall report directly to the city manager.The director of finance shall supervise his office in accordance with the applicable personnel ordinances and shall exercise such powers and perform such duties as are customarily conferred and required by applicable ordinance,resolution or lawful directive.The director of finance shall be appointed and removed by the city manager subject to ratification of the council and shall serve and receive such compensation as shall be determined in accordance with the applicable personnel ordinance. Section 3-3-2 Powers and Duties I t shall be the duty of the department of finance to: A.Plan,direct and control the operations of the finance office,include department personnel,reporting,coordination of activities,and organizational and performance reviews of central accounting systems, including pre -audit,internal audit,posting of expenditure,accounting controls,fiscal and capital budget,payroll,data processing,purchasing, investment program,insurance program,bond program and other related activities. B.Direct receipt,deposit and investment of all city monies,together with records thereof. C.To keep accounts showing all money received and the source and disposition thereof and other such accounts as may be required by statute or ordinance. To keep the city manager/city council fully advised as to the financial condition of the city with the preparation of revenue,expenditure,debt, cost and other statements in such form and in such manner as requested by the city council. D.Direct the recording of all physical properties of the city and the department or office to which the respective properties are assigned. E.Direct the maintenance of all special assessment records and administer the collection of special assessments,including enforcement,collecting and auditing. Section 3-3-3 Vacancies In case the position of director of finance shall become vacant for any reason, the city manager shall apoint a successor subject to ratification by the city council. Article 3-4 Department of Administrative Services Delete and reserve for future use. ORDINANCE NO.724 PAGE 4 OF 5 SECTION I I REPEALING ANY CONFLICTING PROVISIONS All ordinances and parts of ordinances in conflict with the provisions of this ordinance or any part of the code adopted herein by reference are hereby repealed. SECTION III PROVIDING FOR SEVERABILITY I f any section,subsection,sentence,phrase,clause or portion of this ordinance or any part of the code adopted herein by reference is,for any reason,held to be invalid or unconstitutional by any court of competent jurisdiction,such decision shall not affect the validity of the remaining portions thereof.
