HomeMy WebLinkAboutORD728ORDINANCE NO.728 AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA;REPEALING THE DESIGNATION OF CERTAIN LOCATIONS FOR STOP SIGNS THROUGHOUT THE CITY OF APACHE JUNCTION,ARIZONA;REPEALING ANY CONFLICTING PROVISIONS;PROVIDING FOR SEVERABILITY;PROVIDING FOR PENALTIES;AND DECLARING AN EMERGENCY. BE ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA THAT: SECTION I IN GENERAL I t is in the public interest to insure safe,effective and efficient traffic flow throughout the City of Apache Junction,Arizona,and whereas the abandonment of Cactus Wren Street from Wagonwheel Road to Goldfield Road has made i t necessary to repeal the warrant for a stop sign at the following location: Eastbound on Cactus Wren Street at Goldfield Road Furthermore,the Director of Public Works is hereby empowered and directed to initiate appropriate action to remove said traffic control devices. SECTION I I REPEALING AND CONFLICTING PROVISIONS All ordinances and parts of ordinances in conflict with the provisions of this ordinance,or any part of the code adopted herein by reference,are hereby repealed. SECTION III PROVIDING FOR SEVERABILITY I f any section,subsection,sentence,phrase,clause or portion of this ordinance,or any part of the code adopted herein by reference,is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction,such decision shall not affect the validity of the remaining portions thereof. SECTION IV PENALTY CLAUSE Any person found guilty of any violation of or failure or refusal to do or perform any act required by Chapter 12 of this code constitutes a civil traffic violation.Civil traffic violations are subject to the provisions of Title 28, Chapter 6,Article 20 and 21,Arizona Revised Statute,and amendments thereof. ORDINANCE NO.728 PAGE 1 OF 2 • SECTION V EMERGENCY CLAUSE I t is necessary for the preservation of the peace,health and safety of the City of Apache Junction,Arizona,that this ordinance become effective immediately,an emergency is hereby declared to exist and this ordinance shall be effective immediately upon passage and adoption.
