AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF
APACHE JUNCTION,ARIZONA,AMENDING THE APACHE JUNCTION CITY
CODE,CHAPTER 2 MAYOR AND COUNCIL,BY ADDING A NEW ARTICLE
2-21 ECONOMIC DEVELOPMENT COMMISSION;REPEALING ANY CONFLICTING
PROVISIONS;AND PROVIDING FOR SEVERABILITY.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE
JUNCTION,ARIZONA,AS FOLLOWS:
SECTION I IN GENERAL
That the Apache Junction City Code,Chapter 2 Mayor and Council,be amended by
adding a new Article 2-21 Economic Development Commission to read as follows:

Members
Economic Development Commission,hereafter referred to as "the
Commission",is hereby created.The Commission shall serve as an
advisory group of the City of Apache Junction.
2-21-2 Membership and Terms of Office
The initial appointment of members shall be as follows:
Three members with terms beginning on their appointment and expiring
June 30,1991;three members with terms beginning on their appointment
and expiring June 30,1992;and three members with terms beginning on
their appointment and expiring June 30,1993.Thereafter,commission
members shall serve for a term of three years or until their successors
are duly appointed and qualified.

Terms of members shall be so staggered that the terms of no more than
three members shall expire in any one year and,in accordance with this
section,all such terms shall expire on June 30 of the applicable year.
I f a reduction in membership is ever approved by the council,the terms
of office due to expire or unfilled at the time of amendment shall
remain so,and no future appointments shall be made to replace those
members.
C.I t shall not be a requirement for members of this Commission to be city
residents.
D.Members of the Commission may be selected from the following
categories:
Financial Institutions Category,Educators Category,Professional
Services Category,Labor or General Public Category,Utility Services
Category,Development Services Category,Commercial/Industrial
Category.
Section 2-21-3 Salaries and Personal Expenses
The members of the Commission shall receive no salary or other remuneration
for their services in such capacity and shall not be entitled to personal
expenses incurred by them in the discharge of their official duties except
to the extent,purposes and amount such expense is authorized and approved
in advance by the council.
Section 2-21-4 Officers
The Commission shall elect a Chairman and Vice Chairman at the first meeting
of the Commission following the 30th day of June of each year.Such
officers shall serve for one year until the 30th day of June of the next
succeeding year.The Vice Chairman shall preside at the meetings in the
absence of the Chairman.
Section 2-21-5 Meetings
The Commission shall establish a regular meeting day and time at least once
a month.Special meetings may be called as required.All meetings shall be
held in compliance with the Open Meeting Law as provided for in A.R.S.
Section 38-431 as amended.A quorum shall consist of five voting members
for the transaction of all business.
Section 2-21-6 Vacancies
Vacancies shall be filled by the council in accordance with Section 2-21-2
for the unexpired term of the member affected.

Section 2-21-7 Removal of Members
Members of the Commission shall serve at the pleasure of the council and may
be removed by the mayor with concurrence of the council.A member shall not
be absent from regular meetings for more than three consecutive times
without a reasonable excuse.After an absence of three consecutive
meetings,the remaining members of the commission shall vote to retain or to
recommend to the council that the absentee members be relieved of their
duties on the Commission.
Section 2-21-8 Duties
I t shall be the duty of the Commission to support and promote commercial,
industrial and residential retention,expansion,and development through
proactive involvement with the public and private sectors.The Commission
will seek to diversify the City's tax base,facilitate and assist start-up
businesses,create additional employment opportunities,maintain a balance
of mixed use facilities,improve transportation access to existing and
future businesses,and encourage educational,cultural and recreational
opportunitites that contribute toward a well balanced community and an
improved quality of life.Further,the Commission shall develop and
maintain an Economic Development Plan,and shall make recommendations
through the City Manager to City Council on Economic Development programs
and policies.
SECTION I I REPEALING ANY CONFLICTING PROVISIONS
All ordinances and parts of ordinances in conflict with the provisions of this
ordinance or any part of the code adopted herein by reference are hereby
repealed.
SECTION III PROVIDING FOR SEVERABILITY
If any section,subsection,sentence,phrase,clause or portion of this
ordinance or any part of the code adopted herein by reference is,for any
reason,held to be invalid or unconstitutional by any court of competent
jurisdiction,such decision shall not affect the validity of the remaining
portions thereof.
