AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF
APACHE JUNCTION,ARIZONA,AMENDING THE APACHE JUNCTION CITY
CODE,CHAPTER 14 CABLE TELEVISION,SECTIONS 14-1-24 RATES;
14-1-26 TAX SCHEDULE;14-1-32 LICENSE RENEWAL;14-1-37
TRANSFER OF OWNERSHIP;REPEALING ANY CONFLICTING PROVISIONS;AND
PROVIDING FOR SEVERABILITY.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE
JUNCTION,ARIZONA,AS FOLLOWS:
SECTION I IN GENERAL
That the Apache Junction City Code,Chapter 14 Cable Television,Sections
14-1-24 Rates;14-1-26 Tax Schedule;14-1-32 License Renewal and 14-1-37
Transfer of Ownership,be amended to read as follows:
Section 14-1-24 Rates
A.No licensee shall impose upon the subscribers,rates or charges for basic
services,or increases in such rates or charges,unless such rates or
charges are in compliance with the 1984 Cable Act and other applicable state
and federal regulations.
B.Any applicant for a new license or for the renewal or extension of a
license,and any licensee proposing any increases in rates and charges for
the installation of cable or basic services,shall file with the city a
schedule of the proposed rates and charges or the proposed increased rates
and charges.The schedule shall include:
1.Installation of basic service.
2.Periodic charges for basic service.
3.Installation for premium service.
4.Periodic charges for premium service.
5.Installation of FM service.
6.Periodic charges for FM service (including rates for FM service as a
primary service).
7.Charges for locating and reconnection.
8.Converter charges.
9.Charges for parental control keys.
10.Installation charges for bulk/commercial service.
11.Periodic charges for bulk/commercial service.
12.Installation charges for additional outlet service.
13.Periodic charges for additional outlet service.
14.Discounts for multiple premium services,etc.

15.Interactive service charges.
16.Extended drop installation charges.
17.Teletext type service and equipment charges.
18.All other charges proposed.

Section 14-1-32 License Renewal
A.License renewal shall be subject to all applicable federal regulations.
Section 14-1-37 Transfer of Ownership
A.All transfer of ownership transactions shall be in compliance with
applicable sections of federal law.
SECTION I I REPEALING ANY CONFLICTING PROVISIONS
All ordinances and parts of ordinances in conflict with the provisions of this
ordinance or any part of the code adopted herein by reference are hereby
repealed.
SECTION III PROVIDING FOR SEVERABILITY
If any section,subsection,sentence,phrase,clause or portion of this
ordinance or any part of the code adopted herein by reference is,for any
reason,held to be invalid or unconstitutional by any court of competent
jurisdiction,such decision shall not affect the validity of the remaining
portions thereof.
