AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF
APACHE JUNCTION,ARIZONA,AMENDING THE APACHE JUNCTION CITY
CODE,CHAPTER 8 BUSINESS,ARTICLE 8-8 SPECIAL EVENTS,
SECTION 8-8-2 LIMITATIONS ON SPECIAL EVENTS;REPEALING ANY
CONFLICTING PROVISIONS;AND PROVIDING FOR SEVERABILITY.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE
JUNCTION,ARIZONA,AS FOLLOWS:
SECTION I IN GENERAL
That the Apache Junction City Code,Chapter 8 Business,Article 8-8 Special
Events,Section 8-8-2 Limitations on Special Events,be amended to read as
follows:
Section 8-8-2 Limitations on Special Events
A.Any commercial business not in possession of a current,valid city business
license wishing to participate in any special event or special event
(non-profit)shall be subject to payment of all applicable city,county and
state sales tax and shall comply with all applicable sales tax regulations
in addition to paying the following fees to the city:
$10.00 fee per event with participation limited to three consecutive days,
three times per calendar year after which time the participant or
participating entity shall be required to obtain a city license as
stipulated in Article 8-5 of this Code.Previously paid fees shall not be
credited towards or applied to said license.
B.Any commercial business in possession of a current,valid city business
license wishing to participate in any special event or special event
(non-profit)shall be subject to payment of all applicable city,county and
state sales tax and shall comply with all applicable sales tax regulations.
Such commercial businesses as stipulated in this sub -section shall not be
subject to any additional city business license fee.
C.I f a special event is sponsored by a non-profit corporation as defined in
this Article,there shall be no city license fee charged i f the participant
is an individual selling personally -made crafted or painted items on a
casual basis and is not operating as a commercial business.When such non-
commercial participant has met the time limits specified in Subsection A of
ORDINANCE NO.762

this Section;such participant shall be required to obtain a city business
license in accordance with said Subsection A.
D.Nothing in this section shall relieve any participant (commercial or non-
commercial)of any obligation to comply with all requirements pertaining to
the payment of applicable city,county or state sales tax.
SECTION I I REPEALING ANY CONFLICTING PROVISIONS
All ordinances and parts of ordinances in conflict with the provisions of this
ordinance or any part of the code adopted herein by reference are hereby
repealed.
SECTION III PROVIDING FOR SEVERABILITY
I f any section,subsection,sentence,phrase,clause or portion of this
ordinance or any part of the code adopted herein by reference is,for any
reason,held to be invalid or unconstitutional by any court of competent
jurisdiction,such decision shall not affect the validity of the remaining
portions thereof.
