AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF
APACHE JUNCTION,ARIZONA,AMENDING THE APACHE JUNCTION CITY
CODE,CHAPTER 8 BUSINESS,ARTICLE 8-5 BUSINESS OCCUPATIONAL
LICENSE TAX,SECTION 8-5-1 DEFINITIONS,SECTION 8-5-11
SEPARATE LICENSE REQUIRED FOR SEPARATE PLACES OF BUSINESS;
REPEALING ANY CONFLICTING PROVISIONS;AND PROVIDING FOR
SEVERABILITY.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE
JUNCTION,ARIZONA,AS FOLLOWS:
SECTION I IN GENERAL
That the Apache Junction City Code,Chapter 8 Business,Article 8-5 Business
Occupational License Tax,Section 8-5-1 Definitions and Section 8-5-11 Separate
License Required for Separate Places of Business be amended to read as follows:
Section 8-5-1 Definitions
"Temporary Basis"means operating the same kind of business for which a base
business license is issued at other locations and continued for no more than
seven consecutive days at each temporary location.
Section 8-5-11 Separate License Required for Separate Places of Business;
License Use on a Temporary Basis
A.A separate license must be obtained for each permanent branch establishment
or permanent separate place of business in which any trade,business,game
or amusement,calling,profession or occupation is practiced,transacted or
carried on.Each license issued shall authorize the person obtaining i t to
practice,transact,carry on,pursue or conduct only that trade,business,
game or amusement,calling,profession or occupation described in such
license,and only at the permanent location or permanent place of business
described therein.
B.Businesses already in possession of a valid,current city business license
shall be permitted to operate only that trade,business,game or amusement,
calling,profession or occupation described in such license at other
locations within the city limits and continued for no more than seven
consecutive days at each temporary location.Such temporary locations shall
be permitted only as authorized by current zoning,health,tax and license
regulations and such business shall comply with all applicable zoning,
health,tax and license regulations.
C.Businesses already in possess of a valid,current city business license,
other than those solely licensed as peddlers,which wish to operate at

additional temporary locations as defined by Section 8-5-1 of this Code
shall comply with all applicable sales tax regulations in addition to the
following fees:
$10.00 per temporary location with said license to be issued for a
period of twelve consecutive months from the date of issue.
D.The provisions of this Section shall not be construed as being applicable to
those businesses licensed or qualifying as peddlers under this Chapter.All
businesses so defined as peddlers shall only be licensed under the
provisions of Article 8-1.
SECTION I I REPEALING ANY CONFLICTING PROVISIONS
All ordinances and parts of ordinances in conflict with the provisions of this
ordinance or any part of the code adopted herein by reference are hereby
repealed.
SECTION III PROVIDING FOR SEVERABILITY
I f any section,subsection,sentence,phrase,clause or portion of this
ordinance or any part of the code adopted herein by reference is,for any
reason,held to be invalid or unconstitutional by any court of competent
jurisdiction,such decision shall not affect the validity of the remaining
portions thereof.
