HomeMy WebLinkAboutORD779ORDINANCE NO.779 AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA,AMENDING ARTICLES 6.12.13.AND 21 OF THE APACHE JUNCTION.ARIZONA, ZONING ORDINANCE AND ARTICLES III AND VI OF THE APACHE JUNCTION SUBDIVISION REGULATIONS,ESTABLISHING NEW FILING FEES FOR DEVELOPMENT -RELATED APPLICATIONS; REPEALING ANY CONFLICTING PROVISIONS;AND PROVIDING FOR SEVERABILITY. BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA,THAT: SECTION I IN GENERAL The Apache Junction.Arizona Zoning Ordinance is amended as follows: A.SECTION 6.0101(2.b.)is amended to read: b.Nonrefundable filing fee in the amount of $300.00.An amendment (major modification)to a conditional use permit requires a nonrefundable filing fee in the amount of $300.00.A time extension request for a conditional use permit requires a nonrefundable filing fee of $250.00.A continuance of a case requested by the applicant requires a nonrefundable filing fee of $125.00. B.SECTION 12.0101(d.)is amended to read: d.Filing fees for applications to the Board of Adjustments:A nonrefundable filing fee of $50.00 for an appeal of a decision of the Zoning Administrator;a nonrefundable filing fee of $90.00 for a variance involving a single-family dwelling;a nonrefundable filing fee of $250.00 for a variance involving uses more intensive than one single-family dwelling.A continuance of a case requested by the applicant requires a nonrefundable filing fee of $125.00. C.SECTION 13.0103 is amended to read: The applicant,when requesting an amendment identified in the following schedule,shall have the application subject to and accompanied by a filing and investigation fee as set forth in said schedule.However,when initiation is by the City Council,Commission,or other governmental entity in behalf of the public interest,the fee shall be waived. The fee shall be nonrefundable;except where the applicant,by written letter,withdraws said application and the City has not incurred expenses to process the application,then the City may refund the fee less ten percent (10%)administrative charges. ORDINANCE NO.779 PAGE ONE OF THREE The purpose of the fee shall be to defray in part the expenses connected with the application. SCHEDULE OF FILING FEES: 1.Rezoning to a single-family residential classification $250.00 on a site 1.25 gross acres or less 2.Rezoning to a single-family residential classification $400.00 plus on a site greater than 1.25 gross acres $25/acre 3.Rezoning to any other classification $400.00 plus $25/acre 4.Rezoning to a Planned Development District $400.00 plus $25 /acre 5.Major amendment to a Planned Development $400.00 6.Time Extension $-0- 7.Continuance of a case requested by the applicant $125.00 D.SECTION 21.45 is amended to read: The filing fee for a Conditional Use Permit application is as set forth in Section 6.0101(2.b.)of the Zoning Ordinance. The Apache Junction Subdivision Regulations is amended as follows: E.Section 3.07.04(2)is amended to read: 2.A nonrefundable $75.00 filing fee to offset the costs of investigating and processing the application. F.Section 6.03(1)is amended to read: 1.An application for plat approval shall be accompanied by a filing fee as required below to defray processing costs. Preliminary Plat $500.00 Final Plat $500.00 Recordation Fee as established by the county ORDINANCE NO.779 PAGE TWO OF THREE SECTION I I REPEALING ANY CONFLICTING PROVISIONS All ordinances and parts of ordinances in conflict with the provisions of this ordinance or any part of the code adopted herein by reference are hereby repealed. SECTION III PROVIDING FOR SEVERABILITY I f any section,sub -section,sentence,phrase,clause or portion of this ordinance or any part of the code adopted herein by reference is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction,such decision shall not affect the validity of the remaining portion thereof.
