ARIZONA ZONING ORDINANCE,BY AMENDING THE ZONING DISTRICT MAP.CITY OF APACHE JUNCTION. ARIZONA,IN APPROVING REZONING CASE PZ-1-91 BY CHANGING THE ZONING DISTRICT CLASSIFICATION FOR A 4.7 -ACRE PARCEL ON THE NORTHEAST CORNER OF THE INTERSECTION OF IDAHO ROAD AND THE SUPERSTITION FREEWAY FROM GR (GENERAL RURAL)TO C-3/PD (GENERAL COMMERCIAL BY PLANNED DEVELOPMENT);REPEALING ANY CONFLICTING PROVISIONS;AND PROVIDING FOR SEVERABILITY. BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA,THAT: SECTION I IN GENERAL The zoning district classification on the Zoning District Map.City of Apache Junction.Arizona,for the parcel of land described as: The South half of the Northwest quarter of the Southwest quarter of the Northwest quarter of Section 33,Township 1 North,Range 8 East,Gila and Salt River Base and Meridian,Apache Junction,Pinal County,Arizona. be and hereby is amended from GR (General Rural)to C-3/PD (General Commercial by Planned Development);subject to the following stipulations: 1.That a new filing fee and a new application will be required at the time preliminary Planned Development plans are submitted. 2.That the North 40 feet of the property along with a 20 foot by 20 foot cutoff at the corner be dedicated for public roadway and associated purposes along with a 10 foot public utility easement south of the roadway dedication prior to any development of or any division of the subject property. 3.That approval of rezoning constitutes authorization for the development of property under granted zoning.Base rezoning approval is valid for a period of twenty-four (24)months from the date of the City Council decision or for the period of time approved by the City Council as a condition of rezoning.I f approval expires prior to substantial development upon the rezoned property,the zoning shall revert to its former zoning classification without legislative action.If,no later than 150 days prior to the expiration of the zoning,the property owner files a request for a hearing to have the zoning extended for an additional period of time,the Planning and Zoning Commission and the City Council may consider granting the requested extension at their discretion. ORDINANCE NO.780 PAGE ONE OF TWO If the extension is granted,the developer will be obligated to update the final plan and improvements plan to meet current City requirements. SECTION I I REPEALING ANY CONFLICTING PROVISIONS All ordinances and parts of ordinances in conflict with the provisions of this ordinance or any part of the code adopted herein by reference are hereby repealed. SECTION III PROVIDING FOR SEVERABILITY I f any section,sub -section,sentence,phrase,clause or portion of this ordinance or any part of the code adopted herein by reference is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction,such decision shall not affect the validity of the remaining portion thereof.
